No. 82/2009 Building Act 1993 Plumbing Amendment Regulations 2009 The Governor in Council makes the following Regulations: Dated: 14 July 2009 Responsible Minister: JUSTIN MADDEN Minister for Planning TOBY HALLIGAN Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Plumbing Regulations 2008 to prescribe the classes of plumbing work required for registration or a licence to carry out specialised plumbing work. 2 Authorising provisions These Regulations are made under sections 221ZZZV and 262 of the Building Act 1993. 3 Commencement These Regulations come into operation on 1 September 2009. -- 2 of 8 -- Plumbing Amendment Regulations 2009 S.R. No. 82/2009 2 4 Heading to Part 12 substituted For the heading to Part 12 of the Plumbing Regulations 2008 1 substitute— "PART 12—ELIGIBILITY REQUIREMENTS FOR LICENCE OR REGISTRATION". 5 New regulation 37A inserted In Part 12, before regulation 38 of the Plumbing Regulations 2008 insert— "37A Prescribed classes of plumbing work required to carry out specialised plumbing work (1) For the purposes of section 221OA(1)(a) of the Act, the prescribed class of plumbing work required for registration in the class of specialised plumbing work set out in Column 2 of the Table in Schedule 2A is the class of plumbing work set out in Column 3 of that Table corresponding to that class of specialised plumbing work. (2) For the purposes of section 221N(1)(a) of the Act, the prescribed class of plumbing work required for a licence in the class of specialised plumbing work set out in Column 2 of the Table in Schedule 2A is the class of plumbing work set out in Column 4 of that Table corresponding to that class of specialised plumbing work.". r. 4 -- 3 of 8 -- Plumbing Amendment Regulations 2009 S.R. No. 82/2009 4 7 Qualifications and experience requirements to carry out specialised classes of plumbing work For Part 2 of Schedule 3 to the Plumbing Regulations 2008 substitute— "PART 2—QUALIFICATIONS AND EXPERIENCE REQUIRED IN RESPECT OF CLASSES OF SPECIALISED PLUMBING WORK Column 1 Item number Column 2 Class of specialised plumbing work Column 3 Qualifications and experience required for registration under section 221OA of the Act to carry out a class of specialised plumbing work Column 4 Qualifications and experience required for a licence under section 221N of the Act to carry out a class of specialised plumbing work 1 Backflow prevention work The qualification required is the successful completion of the Commission's examination of registration competencies for backflow prevention work. The qualification required is the successful completion of the Commission's examination of licence competencies for backflow prevention work. 2 Refrigerated air- conditioning work The following qualifications are required— (a) the holding of a disconnect/reconnect licence; and (b) either of the following— (i) successful completion of a Certificate III course that includes the approved competency units for refrigerated air- conditioning work; or The following qualifications are required— (a) the holding of a disconnect/reconnect licence; and (b) either of the following— (i) successful completion of a Certificate III course that includes the approved competency units for refrigerated air-conditioning work; or r. 7 -- 5 of 8 -- Plumbing Amendment Regulations 2009 S.R. No. 82/2009 5 Column 1 Item number Column 2 Class of specialised plumbing work Column 3 Qualifications and experience required for registration under section 221OA of the Act to carry out a class of specialised plumbing work Column 4 Qualifications and experience required for a licence under section 221N of the Act to carry out a class of specialised plumbing work (ii) successful completion of the Commission's examination of registration competencies for refrigerated air- conditioning work. Either of the following types of experience are required— (a) completion of a refrigeration apprenticeship; or (b) employment for 4 years in refrigerated air-conditioning work. (ii) successful completion of the Commission's examination of licence competencies for refrigerated air- conditioning work. Either of the following types of experience are required— (a) completion of a refrigeration apprenticeship; or (b) employment for 4 years in refrigerated air-conditioning work. 3 Type A appliance conversion work The qualification required is the successful completion of the Commission's examination of registration competencies for type A appliance conversion work. The qualification required is the successful completion of the Commission's examination of licence competencies for type A appliance conversion work. 4 Type A appliance servicing work The qualification required is the successful completion of the Commission's examination of registration competencies for type A appliance servicing work. The qualification required is the successful completion of the Commission's examination of licence competencies for type A appliance servicing work. r. 7 -- 6 of 8 -- Plumbing Amendment Regulations 2009 S.R. No. 82/2009 6 Column 1 Item number Column 2 Class of specialised plumbing work Column 3 Qualifications and experience required for registration under section 221OA of the Act to carry out a class of specialised plumbing work Column 4 Qualifications and experience required for a licence under section 221N of the Act to carry out a class of specialised plumbing work 5 Type B gasfitting work The following qualifications are required— (a) the holding of a disconnect/reconnect licence; and (b) successful completion of the Commission's examination of registration competencies for type B gasfitting work. The experience required is employment for 2 years in type B gasfitting work. The following qualifications are required— (a) the holding of registration to carry out type B gasfitting work; and (b) successful completion of the Commission's examination of licence competencies for type B gasfitting work. 6 Type B gasfitting advanced work The following qualifications are required— (a) the holding of registration to carry out type B gasfitting work; and (b) successful completion of the Commission's examination of registration competencies for type B gasfitting advanced work. The following qualifications are required— (a) the holding of a licence to carry out type B gasfitting work; and (b) successful completion of the Commission's examination of licence competencies for type B gasfitting advanced work.
