Residential Tenancies Amendment (Prescribed
Tenancy Agreements) Regulations 2009
The Governor in Council makes the following Regulations:

1 Objective
The objective of these Regulations is to amend the
Residential Tenancies Regulations 2008 to
prescribe certain tenancy agreements to be
prescribed agreements.
2 Authorising provisions
These Regulations are made under sections 14
and 511 of the Residential Tenancies Act 1997.
3 Commencement
These Regulations come into operation on
18 February 2009.

4 New regulation 5A inserted
After regulation 5 of the Residential Tenancies
Regulations 2008 1 insert—
"5A Prescribed tenancy agreements
For the purposes of section 14(2) of the Act,
a tenancy agreement is a prescribed
agreement if—
(a) the landlord is the Director of Housing;
and
(b) the tenancy agreement arises because the
tenant was directly affected by the
bushfires that occurred in Victoria in
January 2009 or February 2009.".
