No. 130/2009 Road Safety Act 1986 Road Safety (General) Amendment Regulations 2009 The Governor in Council makes the following Regulations: Dated: 27 October 2009 Responsible Minister: TIM PALLAS Minister for Roads and Ports TOBY HALLIGAN Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Road Safety (General) Regulations 2009 to prescribe certain offences in the Road Safety (Vehicles) Regulations 2009 and the Road Safety (Traffic Management) Regulations 2009 to be traffic infringements. 2 Authorising provision These Regulations are made under section 95 of the Road Safety Act 1986. 3 Commencement These Regulations come into operation on 9 November 2009. -- 2 of 10 -- S.R. No. 130/2009 Road Safety (General) Amendment Regulations 2009 2 4 Principal Regulations In these Regulations, the Road Safety (General) Regulations 2009 1 are called the Principal Regulations. 5 Appropriation of fines In regulation 84(c)(i)(B) of the Principal Regulations, for "Division 1, 2, 3, 4 or 5 of Part 2, Part 4, Part 5 or Part 8 of the Road Safety (Vehicles) Regulations 1999" substitute "Part 2.2, 2.3, 2.4, 2.5 or 2.7 of Chapter 2, Chapter 4, Chapter 5 or Chapter 8 of the Road Safety (Vehicles) Regulations 2009". 6 Schedule 7—Definitions In Schedule 7 to the Principal Regulations, after "RS(D)R means the Road Safety (Drivers) Regulations 2009;" insert— "RS(TM)R means the Road Safety (Traffic Management) Regulations 2009; RS(V)R means the Road Safety (Vehicles) Regulations 2009;". 7 Schedule 7—Failing to give way or stop In column 4 of item 22 of Schedule 7 to the Principal Regulations, after "RR 38," insert "62(1), 63(2), 63(3),". 8 Schedule 7—Change of name or address In column 4 of item 125 of Schedule 7 to the Principal Regulations, after "RS(D)R 67(1)" insert ", RS(V)R 56(1)". r. 4 -- 3 of 10 -- S.R. No. 130/2009 Road Safety (General) Amendment Regulations 2009 3 9 Schedule 7—Heavy vehicles After item 9 of Schedule 7 to the Principal Regulations insert— "9A 2179 Class 1, 2 or 3 vehicle fail to comply with Schedule requirements other than mass or dimension requirements RS(V)R 182(1), 182(2), 182(3), 192(1), 192(2), 192(3), 198(1), 198(2), 198(3) 2 penalty units 9B 2180 Fail to comply with pilot or escort vehicle requirements RS(V)R 183(1), 183(2), 183(3), 184(1), 184(2), 184(3), 185(1), 185(2), 186(1), 186(2) 2 penalty units 9C 2172 Fail to carry and produce documents when required RS(V)R 260(1), 260(2) 1 penalty unit". 10 Schedule 7—Licensing and Registration After item 144 of Schedule 7 to the Principal Regulations insert— "144A 8386 Use of vehicle where number plate not affixed or displayed in accordance with regulations RS(V)R 50(1), 50(2) 1 penalty unit r. 9 -- 4 of 10 -- S.R. No. 130/2009 Road Safety (General) Amendment Regulations 2009 4 144B 2119 Use of vehicle where registration label altered, incorrect, misrepresented or not affixed in accordance with regulations RS(V)R 55(1), 55(2), 245(1), 245(2), 245(3), 245(4), 245(5), 246(1), 246(2), 246(3), 246(4), 246(5), 247(1), 247(2), 247(3), 247(4), 247(5) 1 penalty unit 144C 2120 Fail to return number plates RS(V)R 70(2), 118(2), 118(3) 1 penalty unit 144D 2121 Fail to comply with transfer requirements— non dealer RS(V)R 71(1), 71(2), 71(3) 1 penalty unit 144E 2122 Fail to comply with repossession or restoration requirements RS(V)R 77(1), 77(2) 1 penalty unit 144F 2123 Fail to comply with transfer requirements— dealer RS(V)R 72(1), 73(1) 2 penalty units r. 10 -- 5 of 10 -- S.R. No. 130/2009 Road Safety (General) Amendment Regulations 2009 5 144G 8384 Use of vehicle with altered, incorrect or misrepresented number plate RS(V)R 245(1), 245(2), 245(3), 245(4), 245(5), 246(1), 246(2), 246(3), 246(4), 246(5), 247(1), 247(2), 247(3), 247(4), 247(5) 2 penalty units". 11 Schedule 7—Miscellaneous (1) For item 149 of Schedule 7 to the Principal Regulations substitute— "149 2134 Place or leave dangerous substance on road or leave thing dropped from vehicle on road RR 293(2), RS(TM)R 35 1·25 penalty units". (2) After item 165 of Schedule 7 to the Principal Regulations insert— "165A 1908 Use large vehicle that is unsafe or has been modified or does not comply with the Standards for Registration RS(V)R 257(1), 258(1), 258(2), 259(1) 3·5 penalty units r. 11 -- 6 of 10 -- S.R. No. 130/2009 Road Safety (General) Amendment Regulations 2009 7 12 Schedule 7—Limits and requirements other than mass limits After item 250 of Schedule 7 to the Principal Regulations insert— "250A 4474 Use vehicle exceeding permitted dimensions RS(V)R 174(1), 174(2), 174(3) 2·5 penalty units". 13 Schedule 7—Pedestrians Before item 293 of Schedule 7 to the Principal Regulations and after the heading "Pedestrians" insert— "292A 2241 Fail to obey traffic direction given by police officer or authorised person RR 304(1) 2 penalty units". 14 Schedule 7—Signs After item 314 of Schedule 7 to the Principal Regulations insert— "314A 2509 Fail to obey low clearance or clearance sign RS(V)R 253(1), 253(3), 253(4) 5 penalty units 314B 2513 Exceed mass limit sign by up to 1 tonne RS(V)R 252(2), 252(3), 252(4) 1·5 penalty units 314C 2514 Exceed mass limit sign by 1·01 to 2 tonnes RS(V)R 252(2), 252(3), 252(4) 3 penalty units r. 12 -- 8 of 10 -- S.R.
