No. 146/2009 Supreme Court Act 1986 Supreme Court (Evidence Amendments) Rules 2009 The Judges of the Supreme Court make the following Rules: PART 1—PRELIMINARY 1 Object The object of these Rules is to amend Chapter I and Chapter VI of the Rules of the Supreme Court as a consequence of the enactment of the Evidence Act 2008. 2 Authorising provisions These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers. 3 Commencement These Rules come into operation on 1 January 2010. __________________ -- 2 of 7 -- Part 2—Amendment of Chapter I Supreme Court (Evidence Amendments) Rules 2009 S.R. No. 146/2009 2 PART 2—AMENDMENT OF CHAPTER I 4 Affidavit in support In Rule 22.03(2) of the Supreme Court (General Civil Procedure) Rules 2005 1 for "Evidence Act 1958" substitute "Evidence (Miscellaneous Provisions) Act 1958, the Evidence Act 2008". 5 Nature of directions In Rule 34.02(b) of the Supreme Court (General Civil Procedure) Rules 2005 omit "under section 55(7) of the Evidence Act 1958 or". 6 Taking of depositions In Rule 41.07(1)(c) of the Supreme Court (General Civil Procedure) Rules 2005 after "Evidence" insert "(Miscellaneous Provisions)". 7 Order 41A amended (1) In the heading to Order 41A of the Supreme Court (General Civil Procedure) Rules 2005 after "EVIDENCE" insert "(MISCELLANEOUS PROVISIONS)". (2) In Rule 41A.01 of the Supreme Court (General Civil Procedure) Rules 2005 after "Evidence" insert "(Miscellaneous Provisions)". (3) In Rule 41A.06 of the Supreme Court (General Civil Procedure) Rules 2005 after "Evidence" insert "(Miscellaneous Provisions)". 8 Procedure—Obtaining evidence for external Tribunal In Rule 81.01(1) of the Supreme Court (General Civil Procedure) Rules 2005 after "Evidence" insert "(Miscellaneous Provisions)". r. 4 -- 3 of 7 -- Part 2—Amendment of Chapter I Supreme Court (Evidence Amendments) Rules 2009 S.R. (2) In Rule 2.31(3)(b) of the Supreme Court (Criminal Procedure) Rules 2008 for "Evidence Act 1958" substitute "Evidence (Miscellaneous Provisions) Act 1958". 11 Order 10 amended (1) In the heading to Order 10 of the Supreme Court (Criminal Procedure) Rules 2008 after "EVIDENCE" insert "(MISCELLANEOUS PROVISIONS)".
