No. 103/2008 Gambling Regulation Act 2003 Gambling Regulation (Race Fields) Regulations 2008 The Governor in Council makes the following Regulations: Dated: 2 September 2008 Responsible Minister: ROB HULLS Minister for Racing RYAN HEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is to prescribe— (a) time limits and a form for applications for approval to publish and use Victorian race fields; (b) time limits for determining those applications and notifying the applicants. 2 Authorising provision These Regulations are made under section 11.2.1 of the Gambling Regulation Act 2003. 3 Commencement These Regulations come into operation on the day on which section 6 of the Gambling Legislation Amendment (Problem Gambling and Other Measures) Act 2007 comes into operation. -- 2 of 5 -- S.R. No. 103/2008 Gambling Regulation (Race Fields) Regulations 2008 2 4 Time in which wagering service provider may apply for publication and use approval (1) For the purposes of section 2.5.19C(2)(a) of the Gambling Regulation Act 2003, the prescribed time for making an application for publication and use approval is— (a) subject to subregulation (2), not less than 70 days before the day on which the approval is to expire, if the wagering service provider holds a current publication and use approval from the appropriate controlling body; or (b) not less than 70 days before the day on which the wagering service provider wishes the approval to be granted, if the wagering service provider does not hold a current publication and use approval from the appropriate controlling body. (2) The appropriate controlling body may extend the time under subregulation (1)(a) if satisfied that the wagering service provider has good reason for requiring that extension. 5 Form of application For the purposes of section 2.5.19C(2)(b) of the Gambling Regulation Act 2003, the prescribed form for an application for publication and use approval is the form in Schedule 1. 6 Time in which controlling body must determine application For the purposes of section 2.5.19D(3)(a) of the Gambling Regulation Act 2003, the prescribed time in which an appropriate controlling body must determine an application by either granting or refusing publication and use approval is— r. 4 -- 3 of 5 -- S.R. No. 103/2008 Gambling Regulation (Race Fields) Regulations 2008 3 (a) not less than 10 days before the expiry of the approval, if the wagering service provider holds a current publication and use approval from the appropriate controlling body and makes the application not less than 70 days before that approval is to expire; or (b) not more than 60 days after receiving the application in any other case. 7 Time in which controlling body must notify applicant of decision For the purposes of section 2.5.19D(3)(b) of the Gambling Regulation Act 2003, the prescribed time in which an appropriate controlling body must notify an applicant in writing of its decision to grant or refuse publication and use approval is not more than 7 days after the day on which the decision is made. __________________ r. 7 -- 4 of 5 -- S.R.
