No. 102/2008 Liquor Control Reform Act 1998 Liquor Control Reform Amendment Regulations 2008 The Governor in Council makes the following Regulations: Dated: 2 September 2008 Responsible Minister: TONY ROBINSON Minister for Consumer Affairs RYAN HEATH Clerk of the Executive Council 1 Objective The objective of these Regulations is to amend the Liquor Control Reform Regulations 1999 to establish minimum standards for surveillance equipment in high-risk licensed premises. 2 Authorising provisions These Regulations are made under sections 18B and 180 of the Liquor Control Reform Act 1998. 3 Commencement These Regulations come into operation on 6 October 2008. 4 Principal Regulations In these Regulations, the Liquor Control Reform Regulations 1999 1 are called the Principal Regulations. -- 2 of 6 -- S.R. No. 102/2008 Liquor Control Reform Amendment Regulations 2008 2 5 Objectives (1) In regulation 1(c) of the Principal Regulations, for "polls." substitute "polls;". (2) After regulation 1(c) of the Principal Regulations insert— "(d) to establish minimum standards for security cameras.". 6 Definitions In regulation 3 of the Principal Regulations insert the following definitions— "open format means a published specification for storing digital data that is free of legal restrictions on its use and able to be implemented by both proprietary and free or open source software (such as a bitmap, jpg or tiff file); proprietary format means a file format that is covered by a patent or copyright and is able to be implemented only by proprietary software; stored images means the electronic files exported from a digital video recorder to a storage device or the images on recorded cassettes from an analogue video cassette recorder; video recorder means a digital video recorder or video cassette recorder that records video images from a security camera.". r. 5 -- 3 of 6 -- S.R. No. 102/2008 Liquor Control Reform Amendment Regulations 2008 3 7 New Part 2A inserted After Part 2 of the Principal Regulations insert— "PART 2A—SECURITY CAMERAS 4A Standards for minimum frame rate for security cameras and video recorders (1) For the purposes of section 18B of the Act, a security camera on licensed premises must record continuously at a minimum rate of 5 frames per second. (2) For the purposes of section 18B of the Act, a video recorder on licensed premises must— (a) if it is a digital video recorder, record at least 5 images per second for each security camera connected to the digital video recorder; or (b) if it is a video cassette recorder, continuously record the images from the security camera. 4B Standards for quality of stored images For the purposes of section 18B of the Act, stored images exported from a video recorder must— (a) display the correct time and date stamp of the security camera; and (b) identify the security camera number or the location of the camera; and (c) when exported as a still image be capable of correctly identifying an individual face; and r. 7 -- 4 of 6 -- S.R.
