No. 134/2007 Legal Profession Act 2004 Legal Profession (Practising Certificate Fees) Regulations 2007 The Governor in Council on the recommendation of the Legal Services Board makes the following Regulations Dated: 11 December 2007 Responsible Minister: ROB HULLS Attorney-General MELISSA VAN ROSSUM Acting Clerk of the Executive Council 1 Objective The objective of these Regulations is to prescribe fees to be paid for local practising certificates under the Legal Profession Act 2004 for the remainder of the 2007/2008 financial year and for the 2008/2009, 2009/2010 and 2010/2011 financial years. 2 Authorising provision These Regulations are made under section 7.2.17(2)(b) of the Legal Profession Act 2004. 3 Revocation The Legal Profession (Practising Certificate Fees) (Interim) Regulations 20071 are revoked. 1 -- 2 of 5 -- S.R. No. 134/2007 Legal Profession (Practising Certificate Fees) Regulations 2007 r. 4 4 Practising certificate fees until 30 June 2008 The prescribed fee for a local practising certificate to be in force for the remainder of the financial year beginning on 1 July 2007 is— (a) for a practising certificate authorising the receipt of trust money, $320; (b) for a practising certificate not authorising the receipt of trust money— (i) if the applicant is an Australian legal practitioner, $200; (ii) if the applicant is not an Australian legal practitioner, $160; (c) for a practising certificate in force for part of the financial year only, an amount that bears the same proportion to the relevant fee in paragraph (a) or (b) as the period the certificate is in force bears to the whole financial year, rounded to the nearest dollar. 5 Practising certificate fees from 1 July 2008 The prescribed fee for a local practising certificate to be in force in the financial year beginning 1 July 2008, the financial year beginning 1 July 2009 or the financial year beginning 1 July 2010 is— (a) for a practising certificate authorising the receipt of trust money, $412; (b) for a practising certificate not authorising the receipt of trust money, $256; 2 -- 3 of 5 -- S.R. No. 134/2007 Legal Profession (Practising Certificate Fees) Regulations 2007 r. 5 (c) for a practising certificate in force for part of the relevant financial year only, an amount (rounded to the nearest dollar) calculated on a pro rata basis that bears the same proportion to the relevant fee in paragraph (a) or (b) as the period the certificate is in force, rounded up to the next quarter, bears to the whole financial year. ═══════════════ 3 -- 4 of 5 -- S.R.
