No. 140/2007 Dangerous Goods Act 1985 Occupational Health and Safety (Chrysotile Exemption) Amendment Regulations 2007 The Governor in Council makes the following Regulations: Dated: 11 December 2007 Responsible Minister: TIM HOLDING Minister for Finance, WorkCover and the Transport Accident Commission MELISSA VAN ROSSUM Acting Clerk of the Executive Council 1 Objective The objective of these Regulations is to extend for 3 years the Commonwealth Department of Defence and the Australian Defence Force exemptions from the prohibition on the use or re-use of asbestos-containing material for chrysotile-containing parts and components in essential items where there is no known suitable, non-chrysotile, alternative. 2 Authorising provision These Regulations are made under section 52 of the Dangerous Goods Act 1985. 3 Principal Regulations In these Regulations, the Occupational Health and Safety Regulations 20071 are called the Principal Regulations. 1 -- 2 of 5 -- S.R. No. 140/2007 Occupational Health and Safety (Chrysotile Exemption) Amendment Regulations 2007 r. 4 4 Extension of exemption (1) In regulation 4.3.18(1)(a) of the Principal Regulations, for "a category" substitute "Category 1 or Category 2". (2) After regulation 4.3.18(1) of the Principal Regulations, insert⎯ "(1A) A person is not required to comply with regulations 4.3.16 and 4.3.17 in relation to asbestos-containing material until 1 January 2011 if— (a) the asbestos-containing material contains chrysotile (but not amphibole asbestos) and is of a type, and for a use, that falls within Category 3 specified in Schedule 6; and (b) the person has given a notice to the Authority in accordance with subregulation (2); and (c) the person receives from the Authority a confirmation of receipt of the notice.". (3) In regulation 4.3.18(2) of the Principal Regulations, after "subregulation (1)(b)" insert "or (1A)(b)". (4) In regulation 4.3.18(3) of the Principal Regulations, after "subregulation (1)(b)" insert "or (1A)(b)". 2 -- 3 of 5 -- S.R. No. 140/2007 Occupational Health and Safety (Chrysotile Exemption) Amendment Regulations 2007 r. 5 5 Amendment of Schedule 6 In Schedule 6 to the Principal Regulations, after Category 2 insert⎯ "Category 3 Chrysotile-containing parts and components in relation to which an exemption under the Occupational Health and Safety (Safety Standards) Regulations 1994 of the Commonwealth has been granted to the Commonwealth Department of Defence or the Australian Defence Force.". ═══════════════ 3 -- 4 of 5 -- S.R.
