No. 125/2007 Supreme Court Act 1986 Supreme Court (Sheriff's Fees) Regulations 2007 The Governor in Council makes the following Regulations: Dated: 20 November 2007 Responsible Minister: ROB HULLS Attorney-General CHRISTINE TRAN Acting Clerk of the Executive Council 1 Objective The objective of these Regulations is to prescribe fees for work performed by the Sheriff in or in relation to the execution of any warrant or other process. 2 Authorising provision These Regulations are made under section 129 of the Supreme Court Act 1986. 3 Commencement These Regulations come into operation on 24 November 2007. 4 Revocation The Regulations set out in the Schedule are revoked. 1 -- 2 of 6 -- S.R. No. 125/2007 Supreme Court (Sheriff's Fees) Regulations 2007 r. 5 5 Fees for execution or attempted execution of warrants, or writs or other process by the Sheriff (1) The fee payable for execution or attempted execution of a warrant or writ or other process (except for a warrant of possession, writ of possession or a combined warrant) is— (a) for the first four attempts, 11·5 fee units; (b) for each further two attempts after the first four attempts, 4·8 fee units. (2) The fee payable for execution or attempted execution of every warrant of possession or writ of possession is— (a) for the first two attempts, 14·5 fee units; (b) for each further two attempts after the first two attempts, 14 fee units. (3) The fee payable for execution or attempted execution of a combined warrant (being a warrant or writ of possession to be executed with another warrant or writ, whether or not they are contained in the same document) is 15·9 fee units. 6 Additional fees payable if more than one address specified for execution If a warrant, writ or other process for which a fee is payable under regulation 5 specifies more than one address for execution, an additional fee of 11·9 fee units is payable for each additional address specified in that warrant, writ or process. 7 Additional fees payable on renewal (1) If a warrant, writ or other process is renewed or redirected, the fee payable on the renewal or redirection is 11·9 fee units. 2 -- 3 of 6 -- S.R. No. 125/2007 Supreme Court (Sheriff's Fees) Regulations 2007 r. 8 (2) If the party at whose request the warrant, writ or other process was issued provides instructions to withhold or withdraw from execution, and that party subsequently instructs for execution to proceed, the fee payable on the receipt of those subsequent instructions is 11·9 fee units. 8 Fee payable for supply of a duplicate warrant For the supply by the Sheriff of a duplicate copy of a writ or warrant, the fee payable is $4.40. __________________ 3 -- 4 of 6 -- S.R. No. 125/2007 Supreme Court (Sheriff's Fees) Regulations 2007 Endnotes ENDNOTES Fee Units These Regulations provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004. The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit. The value of a fee unit for the financial year commencing 1 July 2007 is $11.02. The amount of the calculated fee may be rounded to the nearest 10 cents. The value of a fee unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year. 5 -- 6 of 6 --
