No. 150/2007 Transport Act 1983 Transport (Taxi-cab Network Service Provider Accreditation Exemptions) Regulations 2007 The Governor in Council makes the following Regulations: Dated: 18 December 2007 Responsible Minister: LYNNE KOSKY Minister for Public Transport MELISSA VAN ROSSUM Acting Clerk of the Executive Council 1 Objective The objective of these Regulations is to provide for the orderly introduction of the scheme of accreditation enacted by the Transport (Taxi-cab Accreditation and Other Amendments) Act 2006 by exempting specified classes of providers of taxi-cab network services from the requirement to be accredited for specified periods. 2 Authorising provision These Regulations are made under section 137E of the Transport Act 1983. 3 Commencement These Regulations come into operation on 31 December 2007. 1 -- 2 of 4 -- S.R. No. 150/2007 Transport (Taxi-cab Network Service Provider Accreditation Exemptions) Regulations 2007 r. 4 4 Definitions In these Regulations— accredited means accredited under Division 4 of Part VI of the Act as a provider of taxi-cab network services; Act means the Transport Act 1983; commencement day means the day on which section 3 of the Transport (Taxi-cab Accreditation and Other Amendments) Act 2006 comes into operation. 5 Exemptions (1) A person who provides taxi-cab network services described in at least paragraphs (a), (b) and (e) of the definition of taxi-cab network service in section 130A(1) of the Act to or in respect of 40 or more taxi-cabs is exempt from the requirement to be accredited for the period— (a) commencing on the commencement day; and (b) ending on 30 June 2008. (2) A person who provides taxi-cab network services described in at least paragraphs (a), (b) and (e) of the definition of taxi-cab network service in section 130A(1) of the Act to or in respect of fewer than 40, but more than 9, taxi-cabs is exempt from the requirement to be accredited for the period— (a) commencing on the commencement day; and (b) ending on 31 March 2009. 2 -- 3 of 4 -- S.R. No. 150/2007 Transport (Taxi-cab Network Service Provider Accreditation Exemptions) Regulations 2007 r. 5 (3) A person who provides taxi-cab network services described in at least paragraphs (a) and (e) of the definition of taxi-cab network service in section 130A(1) of the Act to or in respect of 9 or fewer taxi-cabs is exempt from the requirement to be accredited for the period— (a) commencing on the commencement day; and (b) ending on 30 June 2009. (4) A person who provides taxi-cab network services described in at least paragraph (a) of the definition of taxi-cab network service in section 130A(1) of the Act, but not taxi-cab network services described in paragraph (b) or paragraph (e) of that definition, is exempt from the requirement to be accredited for the period— (a) commencing on the commencement day; and (b) ending on 31 August 2009. ═══════════════ 3 -- 4 of 4 --
