1 Fair Work Act 2009 s.372—General protections Abbas Raza v Harbour Roof Tiling Pty Ltd (C2016/6920) SENIOR DEPUTY PRESIDENT DRAKE SYDNEY, 24 FEBRUARY 2017 Application to deal with contraventions involving dismissal. [1] Mr Raza lodged an application pursuant to section 372 of the Fair Work Act 2009 (the Act)1 on 24 November 2016. [2] Mr Raza also lodged an application pursuant to s.394 of the Act2 on 28 September 2016. [3] A s.372 application relates to a dispute in the course of employment i.e. when no termination of employment has occurred. [4] I listed both applications on Tuesday, 24 January 2017 to assist Mr Raza to understand his claims and to determine which application would proceed. [5] Mr Raza was accompanied by a support person and I arranged for an interpreter to attend and assist. [6] At the hearing Mr Raza’s position was that his employment had been terminated.
