1 Fair Work Act 2009 s.394—Unfair dismissal Allan West v Holcim (Australia) Pty Ltd (U2016/14182) DEPUTY PRESIDENT LAWRENCE SYDNEY, 2 MAY 2017 Application for relief from unfair dismissal. Further to a decision given on 2 May 2017 [2017] FWC 2346, the Fair Work Commission orders: 1. Pursuant to s.391 of the Fair Work Act 2009 (the Act) that Holcim (Australia) Pty Ltd (the Respondent) reinstates Mr Allan West (the Applicant) to the position in which he was employed immediately prior to his dismissal. 2. Reinstatement will operate from the date of this Order. 3. The continuity of the Applicant’s employment shall be maintained. 4. The Applicant shall be paid a sum equivalent to wages lost from the date of his dismissal to the date of this Order less $3,000 and less five weeks’ payment that he received in lieu of notice.
