No. 151/2006 Catchment and Land Protection Act 1994 Catchment and Land Protection (Register of Interests) Regulations 2006 The Lieutenant-Governor as the Governor's Deputy with the advice of the Executive Council makes the following Regulations: Dated: 24 October 2006 Responsible Minister: JOHN THWAITES Minister for Environment RUTH LEACH Clerk of the Executive Council 1. Objective The objective of these Regulations is— (a) to prescribe the form of returns under section 18K of the Catchment and Land Protection Act 1994; and (b) to provide for applications relating to the register of interests under section 18M of the Catchment and Land Protection Act 1994. 2. Authorising provision These Regulations are made under section 95 of the Catchment and Land Protection Act 1994. 3. Commencement These Regulations come into operation on 31 October 2006. -- 2 of 5 -- S.R. No. 151/2006 Catchment and Land Protection (Register of Interests) Regulations 2006 2 4. Definition In these Regulations— "the Act" means the Catchment and Land Protection Act 1994. 5. Primary return For the purposes of section 18K(1) and (3) of the Act, the prescribed form of a primary return is in the form of Schedule 1. 6. Ordinary return For the purposes of section 18K(4) of the Act, the prescribed form of an ordinary return is in the form of Schedule 2. 7. Inspection of register of interests (1) A person who applies in writing to inspect the register maintained under section 18M(1) of the Act must, in that application, include— (a) the applicant's full name, address and telephone number; and (b) a statement that the application to inspect the register is made under section 18M(2) of the Act; and (c) the name of the Authority whose register is to be inspected; and (d) the identification of the returns to be inspected by reference to the name of any member or nominated officer whose returns are included on the register; and (e) the applicant's reason for applying to inspect the register. (2) An application under sub-regulation (1) must be signed by the applicant and dated. __________________ r. 4 -- 3 of 5 -- S.R. The name of any company or other body, corporate or unincorporate, in which you hold an office whether as a director or otherwise. 2. The name or description of any company, partnership, association or other body in which you hold a beneficial interest exceeding $2000 in value. 3. The address or description of any land in the region of the Authority or in a region which adjoins the Authority's region in which you hold any beneficial interest other than by way of security for any debt. 4. A concise description of any trust in which you hold a beneficial interest or of which you are a trustee and in which a relative, as defined in section 18L(4) of the Catchment and Land Protection Act 1994, holds a beneficial interest. 5. Any other substantial interest, whether of a pecuniary nature or not, of yours or of a relative, as defined in section 18L(4) of the Catchment and Land Protection Act 1994, of which you are aware and which you ought reasonably to consider might appear to raise a material conflict between your private interest and your public duty as a member or nominated officer (as the case may be). The name of any company or other body, corporate or unincorporate, in which you held an office whether as a director or otherwise. 2. The name or description of any company, partnership, association or other body in which you held a beneficial interest exceeding $2000 in value. 3. The address or description of any land in the region of the Authority or in a region which adjoins the Authority's region in which you held any beneficial interest other than by way of security for any debt. 4.
