No. 20/2006 Commonwealth Games Arrangements Act 2001 Commonwealth Games Arrangements (Games Management Areas) Regulations 2006 The Governor in Council makes the following Regulations: Dated: 28 February 2006 Responsible Minister: JUSTIN MADDEN Minister for Commonwealth Games JUSTINE FRANKLIN Acting Clerk of the Executive Council 1. Objective The objective of these Regulations is to provide for the care, control, management and use of Games management areas and good order and public safety in those areas. 2. Authorising provision These Regulations are made under section 57 of the Commonwealth Games Arrangements Act 2001. 3. Definitions In these Regulations— "animal" means— (a) a live member of a vertebrate species including— (i) any fish; and -- 2 of 8 -- S.R. No. 20/2006 Commonwealth Games Arrangements (Games Management Areas) Regulations 2006 2 (ii) any amphibian; and (iii) any reptile; and (iv) any bird; and (v) any mammal (other than a human being); or (b) a live crustacean; "body of water" includes a cascade, fountain, pond, pool or watercourse; "the Act" means the Commonwealth Games Arrangements Act 2001. 4. Application These Regulations apply during— (a) a Games period; or (b) any period other than a Games period if an order under section 28E of the Act is in force. 5. Consuming alcohol (1) A person in a Games management area must not consume any alcohol other than in an area licensed in accordance with the Liquor Control Reform Act 1998 except— (a) with the written authority of the Secretary; or (b) otherwise in accordance with the Act. Penalty: 2 penalty units. (2) An authorised officer or a member of the police force who believes on reasonable grounds that a person is contravening or has contravened sub- regulation (1) may direct the person to dispose of any unconsumed alcohol remaining in that person's possession. r. 4 -- 3 of 8 -- S.R. No. 20/2006 Commonwealth Games Arrangements (Games Management Areas) Regulations 2006 3 (3) A person must comply with a direction given by an authorised officer or a member of the police force under sub-regulation (2). Penalty: 2 penalty units. 6. Possessing alcohol in an unsealed container (1) A person in a Games management area must not possess any alcohol in an unsealed container other than in an area licensed in accordance with the Liquor Control Reform Act 1998 except— (a) with the written authority of the Secretary; or (b) otherwise in accordance with the Act. Penalty: 2 penalty units. (2) An authorised officer or a member of the police force who believes on reasonable grounds that a person is contravening or has contravened sub- regulation (1) may direct the person— (a) to seal any unsealed container of alcohol; or (b) to dispose of the contents of any unsealed container of alcohol. (3) A person must comply with a direction given by an authorised officer or a member of the police force under sub-regulation (2). Penalty: 2 penalty units. 7. Conduct within Games management areas (1) A person within a Games management area must not disrupt or interfere with— (a) the comfort of any person in a Games management area; or (b) the enjoyment by any person of a Commonwealth Games event. Penalty: 5 penalty units. r. 6 -- 4 of 8 -- S.R. No. 20/2006 Commonwealth Games Arrangements (Games Management Areas) Regulations 2006 4 (2) A person must not within a Games management area act or conduct himself or herself in such a way as to adversely affect the safety of the public. Penalty: 5 penalty units. 8. Operating device or equipment at high volume A person within a Games management area must not play or operate any device or equipment which produces a sound at a volume likely to cause inconvenience or nuisance to other persons in the Games management area except— (a) with the written authority of the Secretary; or (b) otherwise in accordance with the Act. Penalty: 5 penalty units. 9. Public speaking A person within a Games management area must not preach, declaim or harangue, or deliver any address that may disturb or cause annoyance to other persons in the Games management area except— (a) with the written authority of the Secretary; or (b) otherwise in accordance with the Act. Penalty: 5 penalty units. 10. Protection of vegetation A person must not intentionally cut, fell, pick, remove, take, destroy or damage any tree, plant or other vegetation in a Games management area, whether the tree, plant or other vegetation is alive or dead except— (a) with the written authority of the Secretary; or (b) otherwise in accordance with the Act. Interfering with rocks or similar natural objects A person must not intentionally damage, deface, remove or otherwise interfere with any rock or similar natural object in a Games management area except— (a) with the written authority of the Secretary; or (b) otherwise in accordance with the Act. Penalty: 5 penalty units. 12. Water activities (1) A person must not bathe, paddle, swim or wade in a body of water in a Games management area. Penalty: 5 penalty units. (2) Sub-regulation (1) does not apply to any person who— (a) is a participant in a Commonwealth Games event; or (b) is engaged in the control or management of a Commonwealth Games event or officiating at a Commonwealth Games event; or (c) is officially acting as a volunteer engaged in the management or conduct of a Commonwealth Games event; or (d) is, or is a member of a class of person that is, otherwise authorised to bathe, paddle, swim or wade in a body of water in a Games management area. (3) A person must not allow an animal under that person's control to bathe, paddle or swim in a body of water in a Games management area. Penalty: 5 penalty units. r. 11 -- 6 of 8 -- S.R. No. 20/2006 Commonwealth Games Arrangements (Games Management Areas) Regulations 2006 6 (4) A person must not deposit, throw or otherwise place anything on or into a body of water in a Games management area unless the person does so— (a) for or in connection with the conduct or management of a Commonwealth Games event; or (b) with the written authority of the Secretary; or (c) otherwise in accordance with the Act. Penalty: 5 penalty units. 13. Disturbing or feeding animals (1) A person must not disturb, harass, remove, hunt, capture, take, kill or injure or otherwise destroy or interfere with any animal in a Games management area. Penalty: 5 penalty units. (2) A person must not destroy, disturb or interfere with the nest, bower, display mound, lair or burrow of any animal in a Games management area. Penalty: 5 penalty units. (3) A person must not feed, offer food or offer any object as food to any animal in a Games management area unless that person is feeding, offering food or offering any object as food to an animal he or she has lawfully brought into a Games management area— (a) with the written authority of the Secretary; or (b) otherwise in accordance with the Act. Dog litter (1) The owner or other person in charge of a dog (other than a guide dog or police dog) must immediately collect and remove any excrement left by the dog in a Games management area. Penalty: 5 penalty units. (2) The owner or other person in charge of a dog (other than a guide dog or police dog) in a Games management area must carry a receptacle, dispenser, bag or other similar device in which to place the excrement of the dog when with the dog in the Games management area. Penalty: 5 penalty units. 15. Camping A person must not camp in a Games management area, whether or not in a vehicle, tent, caravan or any other type of temporary structure or accommodation except— (a) with the written authority of the Secretary; or (b) otherwise in accordance with the Act.
