No. 16/2006 Drugs, Poisons and Controlled Substances Act 1981 Drugs, Poisons and Controlled Substances (Amendment) (Nurse Practitioners - Palliative Care) Regulations 2006 The Governor in Council makes the following Regulations: Dated: 22 February 2006 Responsible Minister: BRONWYN PIKE Minister for Health JUSTINE FRANKLIN Acting Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend the Drugs, Poisons and Controlled Substances Regulations 1995 to make provision for the obtaining and the possession, use, sale and supply of certain Schedule 2 poisons, Schedule 3 poisons, Schedule 4 poisons and Schedule 8 poisons by a new category of nurse practitioner under the Drugs, Poisons and Controlled Substances Act 1981. 2. Authorising provisions These Regulations are made under sections 129, 132 and 132B of the Drugs, Poisons and Controlled Substances Act 1981. -- 2 of 6 -- S.R. New category of nurse practitioner–palliative care After regulation 4A(3) of the Drugs, Poisons and Controlled Substances Regulations 19951 , insert— "(4) The prescribed Schedule 2 poisons, Schedule 3 poisons, Schedule 4 poisons and Schedule 8 poisons that a nurse practitioner whose registration is endorsed with the category of nurse practitioner–palliative care is authorised to obtain and have in his or her possession and to use, sell or supply are the poisons set out in Part 4 of Schedule 3.". 4. Amendment of Schedule 3 After Part 3 of Schedule 3 to the Drugs, Poisons and Controlled Substances Regulations 1995, insert— "PART 4 NURSE PRACTITIONER–PALLIATIVE CARE The prescribed poisons that a nurse practitioner–palliative care is authorised to obtain and have in his or her possession and to use, sell or supply are the substances listed below— Schedule 2 poisons— Aspirin Atropa Belladonna Atropine Sulphate Codeine Hyoscine Butylbromide Ibuprofen Loperamide Miconazole Naproxen Nystatin Pholcodine Ranitidine r. 3 -- 3 of 6 -- S.R.
