No. 106/2006 Estate Agents Act 1980 Estate Agents (Infringements) Regulations 2006 The Governor in Council makes the following Regulations: Dated: 15 August 2006 Responsible Minister: MARSHA THOMSON Minister for Consumer Affairs RUTH LEACH Clerk of the Executive Council 1. Objective The objective of these Regulations is— (a) to specify certain offences under the Estate Agents Act 1980 and the Estate Agents (General, Accounts and Audit) Regulations 1997, in respect of which an infringement notice may be issued; and (b) to prescribe penalties for those offences. 2. Authorising provision These Regulations are made under section 99 of the Estate Agents Act 1980. 3. Commencement These Regulations come into operation on 15 August 2006. -- 2 of 5 -- S.R. Offences for which infringement notices may be issued (1) For the purposes of section 95A of the Estate Agents Act 1980, an offence against a provision of that Act or the Estate Agents (General, Accounts and Audit) Regulations 19971 set out in column 1 of the Schedule is specified as an offence in respect of which an infringement notice may be issued. (2) The prescribed infringement penalty for an offence against a provision set out in column 1 of the Schedule is the relevant amount expressed in penalty units set out in column 2 of the Schedule in respect of that offence. 5. Expiry These Regulations expire and cease to have any force or effect on 1 July 2010. __________________ r. 4 -- 3 of 5 -- S.R.
