No. 71/2006 Gambling Regulation Act 2003 Gambling Regulation (Infringement Offences) Regulations 2006 The Governor in Council makes the following Regulations: Dated: 20 June 2006 Responsible Minister: JOHN PANDAZOPOULOS Minister for Gaming RUTH LEACH Clerk of the Executive Council 1. Objective The objective of these Regulations is to prescribe certain offences under the Gambling Regulation Act 2003 and the Casino Control Act 1991 as offences in respect of which an infringement notice may be issued and to prescribe penalties for those offences. 2. Authorising provision These Regulations are made under section 11.2.1 of the Gambling Regulation Act 2003. 3. Commencement These Regulations come into operation on 1 July 2006. -- 2 of 6 -- S.R. Offences prescribed as infringement offences and prescribed penalties (1) For the purposes of section 10.5.20(1) of the Gambling Regulation Act 2003, an offence against a provision set out in Column 2 of Schedule 1 is prescribed as an offence in respect of which an infringement notice may be issued. (2) For the purposes of section 10.5.21 of the Gambling Regulation Act 2003, the prescribed infringement penalty for an offence against a provision set out in Column 2 of Schedule 1 is the relevant amount set out in Column 3 of Schedule 1 in respect of that offence. (3) A summary of an offence in Column 4 of Schedule 1 is not to be taken to affect— (a) the nature or elements of the offence to which the summary refers; or (b) the operation of these Regulations. 5. No. 71/2006 Gambling Regulation (Infringement Offences) Regulations 2006 5 ENDNOTES Penalty Units These Regulations provide for penalties by reference to penalty units established under the Monetary Units Act 2004. The amount of the penalty is to be calculated, in accordance with section 7 of that Act, by multiplying the number of penalty units applicable by the value of a penalty unit. The value of a penalty unit for the financial year commencing 1 July 2006, is $107.43. The amount of the calculated penalty may be rounded to the nearest dollar. The value of a penalty unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a penalty unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year. Endnotes -- 6 of 6 --
