Cemeteries (Incorporation of Trusts) (Amendment)
Regulations 2005
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to amend the
Cemeteries (Incorporation of Trusts) Regulations
1995—
(a) to amalgamate The Lorne Cemetery Trust,
The Mount Moriac Cemetery Trust and
The Winchelsea Cemetery Trust to form
The Surf Coast Cemeteries Trust; and
(b) to provide for the administration of the
Gulawarra Heights Memorial Park by
The Warragul Cemetery Trust.
2. Authorising provisions
These Regulations are made under sections 3
and 92 of the Cemeteries Act 1958.

3. The Surf Coast Cemeteries Trust
(1) In the Schedule to the Cemeteries (Incorporation
of Trusts) Regulations 19951 —
(a) in the item relating to The Lorne Cemetery
Trust—
(i) in column 1 omit "The Lorne Cemetery
Trust"; and
(ii) in column 2 omit "Lorne Public
Cemetery";
(b) in the item relating to The Mount Moriac
Cemetery Trust—
(i) in column 1 omit "The Mount Moriac
Cemetery Trust"; and
(ii) in column 2 omit "Mount Moriac
Public Cemetery";
(c) in the item relating to The Winchelsea
Cemetery Trust—
(i) in column 1 omit "The Winchelsea
Cemetery Trust"; and
(ii) in column 2 omit "Winchelsea Public
Cemetery";
(d) after the item relating to The Sunbury
Cemetery Trust—
(i) in column 1 insert "The Surf Coast
Cemeteries Trust";
(ii) in column 2 insert—
"(a) Lorne Public Cemetery
(b) Mount Moriac Public Cemetery
(c) Winchelsea Public Cemetery".

(2) The Surf Coast Cemeteries Trust is created and
appointed to administer the following public
cemeteries—
(a) Lorne Public Cemetery;
(b) Mount Moriac Public Cemetery;
(c) Winchelsea Public Cemetery.
(3) The Lorne Cemetery Trust, The Mount Moriac
Cemetery Trust and The Winchelsea Cemetery
Trust are abolished and all the assets and
liabilities of those trusts are transferred to
The Surf Coast Cemeteries Trust.
4. The Warragul Cemetery Trust
(1) In the Schedule to the Cemeteries (Incorporation
of Trusts) Regulations 1995, in the item relating to
The Warragul Cemetery Trust, in column 2, for
"Warragul Public Cemetery" substitute—
"(a) Warragul Public Cemetery
(b) Gulawarra Heights Memorial Park".
(2) The Warragul Cemetery Trust is appointed to
administer the Gulawarra Heights Memorial Park
in addition to the Warragul Public Cemetery.
