No. 54/2005 Crimes (Family Violence) Act 1987 Crimes (Family Violence) Regulations 2005 The Governor in Council makes the following Regulations: Dated: 15 June 2005 Responsible Minister: ROB HULLS Attorney-General RUTH LEACH Acting Clerk of the Executive Council 1. Objective The objective of these Regulations is to prescribe a form of certificate of non-attendance by a defendant at— (a) an assessment for eligibility for counselling; and (b) a counselling appointment— under the Crimes (Family Violence) Act 1987. 2. Authorising provision These Regulations are made under section 26 of the Crimes (Family Violence) Act 1987. 3. Certificate of non-attendance—Form 1 For the purposes of section 8N of the Crimes (Family Violence) Act 1987, a certificate is in the prescribed form if it is in Form 1. -- 2 of 3 -- S.R. No. 54/2005 Crimes (Family Violence) Regulations 2005 2 FORM 1 Crimes (Family Violence) Act 1987 (section 8N) CERTIFICATE OF NON-ATTENDANCE *1. (If the order is for a defendant to be assessed as to eligibility for counselling) I, [name of person specified in the order to perform the assessment] was to assess [name of defendant] at [time] at [place] on [date] concerning *his/her eligibility for counselling under the terms of an order made by the Family Violence Court Division of the Magistrates' Court at [venue] on [date of order]. *1. (If the order is for a defendant to attend counselling) I, [name of person specified in the order to provide counselling or if a body was specified in the order to provide counselling, name of representative of the body] was to provide counselling to [name of defendant] at [time] at [place] on [date] under the terms of an order made by the Family Violence Court Division of the Magistrates' Court at [venue] on [date of order]. Note: The time place and date referred to above may be— *(a) as specified in the order; or *(b) as varied by the registrar; or *(c) if for subsequent counselling, as notified by the person or body who is to provide the subsequent counselling. 2.
