No. 158/2005 Electricity Safety Act 1998 Electricity Safety (Network Assets) (Amendment) Regulations 2005 The Lieutenant-Governor as the Governor's Deputy with the advice of the Executive Council makes the following Regulations: Dated: 7 December 2005 Responsible Minister: THEO THEOPHANOUS Minister for Energy Industries RUTH LEACH Clerk of the Executive Council 1. Objective The objective of these Regulations is to make miscellaneous amendments to improve the operation of the Electricity Safety (Network Assets) Regulations 1999. 2. Authorising provisions These Regulations are made under sections 149, 151 and 157 of the Electricity Safety Act 1998. 3. Principal Regulations In these Regulations, the Electricity Safety (Network Assets) Regulations 19991 are called the Principal Regulations. -- 2 of 11 -- S.R. Definitions In regulation 5(1) of the Principal Regulations— (a) after the definition of "live" insert— ' "load" in relation to a vehicle, means goods, livestock or people;'; (b) for the definition of "minimum depth" substitute— ' "minimum depth" in relation to a part of an underground line that is below the surface of the ground, means the minimum depth of that part of the line from the uppermost surface of the line or the conduit and pipe enclosing the line;'. 5. Minimum distances between aerial lines and the ground In Table 13.2 of the Principal Regulations, in the first column, for "Alternating current bare or covered" substitute "Bare or covered (other than d.c. traction conductors)". 6. Minimum distances between aerial lines and parts of buildings and structures (1) In regulation 14(1) of the Principal Regulations, for "carrying alternating current" substitute "(other than a d.c. traction conductor)". (2) In regulation 14(2) of the Principal Regulations, for "An aerial line carrying direct current" substitute "A d.c. traction conductor". (3) In Table 14.1 of the Principal Regulations— (a) in the heading omit "carrying alternating current"; r. 4 -- 3 of 11 -- S.R. (4) In Table 14.2 of the Principal Regulations— (a) in the heading, for "aerial lines carrying direct current" substitute "d.c. traction conductors"; (b) in the first column, for "Direct current aerial line" substitute "d.c. traction conductor". 7. Minimum distances between aerial lines and parts of railway systems (1) In regulation 16 of the Principal Regulations insert the following heading— "Minimum distances between aerial lines and parts of railway systems". (2) In regulations 16(1) and 16(2) of the Principal Regulations, for "d.c. train traction conductor" (wherever occurring) substitute "train d.c. traction conductor". (3) In regulations 16(2) and 16(3) and in the heading to Table 16 of the Principal Regulations omit "carrying alternating current". (4) In Table 16 of the Principal Regulations— (a) in the first column, for "Alternating current aerial line" substitute "Aerial line (other than d.c. traction conductors)"; (b) for "U < 1kV" substitute "U < 1kV". r. 7 -- 4 of 11 -- S.R. Minimum distances between aerial lines and parts of tramway systems (1) In regulation 17 of the Principal Regulations— (a) insert the following heading— "Minimum distances between aerial lines and parts of tramway systems"; (b) for "carrying alternating current" substitute "(other than a d.c. traction conductor)". (2) In Table 17 of the Principal Regulations— (a) in the heading omit "carrying alternating current"; (b) in the first column, for "Alternating current aerial line" substitute "Aerial line (other than a d.c. traction conductor)". 9. Minimum distances between conductors of aerial lines In Table 18 of the Principal Regulations— (a) in row 2, for "900mm" substitute "600mm"; (b) in rows 6 and 7, for "U < 11kV" substitute "U < 11kV"; (c) in rows 8 and 9, for "U < 33kV" substitute "U < 33kV"; and (d) in rows 10 and 11, for "U < 66kV" substitute "U < 66kV". r. 8 -- 5 of 11 -- S.R. Construction of underground lines In the Principal Regulations— (a) in regulation 20(4)(a) omit "rigid,"; (b) in Table 20, insert the following row at the foot of the Table— " Direct current 66kV < U < 500kV 1000mm 1000mm 1000mm". 11. Mechanical protection of underground lines above the ground In regulation 21(3) of the Principal Regulations omit "rigid". 12. Pole mounted substations In regulation 22(3)(b) of the Principal Regulations, for "and is less than 200 millimetres" substitute "and is 200 millimetres or less". 13. Earthing and electrical protection In regulation 23(6)(c) of the Principal Regulations, for "aerial service line is" substitute "aerial service line was". 14. Warning signs In regulation 24(3) of the Principal Regulations— (a) after "If an aerial line crosses water" insert "at a point where the water is navigable"; (b) in paragraph (c), for "20 metres" substitute "at a point that is between 20 and 100 metres". r. 10 -- 6 of 11 -- S.R. Marking of network assets For regulation 26(2) of the Principal Regulations substitute— "(2) Underground lines, other than extra low voltage lines, buried in any part of a road or footpath must be identified by an orange marker tape in accordance with AS/NZS 2648.1 at least 150 millimetres above the uppermost surface of the line or the conduit or pipe enclosing the line. (3) Sub-regulation (2) does not apply to an underground line that is installed by the process of boring.". 16. Standard of upstream networks In regulation 29 of the Principal Regulations, for "AS 2926" substitute "AS/NZS 60038". 17. Minimum distances between parts of buildings, structures, scaffolding and posts and aerial lines of network operators In Table 38 of the Principal Regulations— (a) for "Alternating current aerial lines" (wherever occurring) substitute "All other aerial lines"; (b) for "d.c. street" (wherever occurring) substitute "tram d.c."; (c) for "d.c. train" (wherever occurring) substitute "train d.c."; (d) in the third row, for "In any direction from those parts a building," substitute "In any direction (other than vertical) from those parts of a building,"; (e) in the fourth row, after "In any direction" insert "(other than vertical)". r. 15 -- 7 of 11 -- S.R. Minimum distances between materials and network assets (1) In regulation 39(a) of the Principal Regulations, after "switch yard" insert "of a network operator". (2) In Table 39 of the Principal Regulations— (a) for "Alternating current aerial lines" substitute "All other aerial lines"; (b) in the column headed "132kV < U < 275kV", for "4600mm" (wherever occurring) substitute "4500mm". 19. Minimum distances between vehicles, plant, machinery and vessels and overhead network assets In Table 40 of the Principal Regulations, for "Alternating current" substitute "All other". 20. Minimum distances between transported loads and overhead network assets (1) In regulation 41 of the Principal Regulations, after "at any time," insert "any part of the vehicle or". (2) For regulation 41(b) of the Principal Regulations substitute— "(b) the maximum height and width of the loaded vehicle; and". (3) In Table 41 of the Principal Regulations— (a) omit "alternating current"; (b) for "U < 1500V d.c. traction conductor" substitute "U < 1kV bare conductor and U < 1500V d.c. traction conductor"; (c) for "U < 66kV" substitute "U ≤ 66kV"; (d) for "700mm" substitute "600mm"; (e) for "6400mm" substitute "6000mm". r. 18 -- 8 of 11 -- S.R. Minimum distances between conductors of aerial lines and network assets (1) In Table 42.1 of the Principal Regulations— (a) in rows 7 and 8, for "U < 11kV" substitute "U < 11kV"; (b) in rows 9, 10 and 11, for "U < 33kV" substitute "U < 33kV"; (c) in rows 12, 13 and 14, for "U < 66kV" substitute "U < 66kV"; (d) in row 14, for "line < 66kV" substitute "line < 66kV". (2) In Table 42.2 of the Principal Regulations, for "Alternating current" substitute "All other". 22. Minimum distances between people and conductors of aerial lines of network operators In the heading to column 2 of Table 43 of the Principal Regulations omit "alternating current". 23. Placing of materials In regulation 44 of the Principal Regulations, for "substation or switchyard" (wherever occurring) substitute "substation, switchroom or switchyard of a network operator". 24. Exemption for existing aerial lines (1) In regulation 47(1) of the Principal Regulations, after "an aerial service line over a driveway" insert "or land traversable by vehicles". (2) For regulation 47(3) of the Principal Regulations substitute— '(3) On the replacement of an aerial service line that fails to comply with the minimum clearance specified by the Electricity Safety (Network Assets) Regulations 1997, if a r. 21 -- 9 of 11 -- S.R. No. 158/2005 Electricity Safety (Network Assets) (Amendment) Regulations 2005 9 network operator demonstrates to the Office that it is not reasonably able to comply with regulation 13, the service line may be replaced in its existing position, and the replacement may be maintained in that position for up to 24 months after the replacement occurs, if the network operator advises the occupier in writing, within 5 business days after the replacement, of the need for the network operator to ensure that the aerial service line is made compliant with the minimum clearance required by Table 13.1 within 24 months after the service line replacement. (4) In this regulation, "occupier", in relation to premises to which the aerial service line is attached, means a person who is in actual occupation of the premises or, if no-one is in actual occupation of the premises, the owner of the premises.'. ═══════════════ r. 24 -- 10 of 11 -- S.R.
