No. 93/2005 Health Act 1958 Health (Exempt Businesses) Regulations 2005 The Governor in Council makes the following Regulations: Dated: 27 July 2005 Responsible Minister: BRONWYN PIKE Minister for Health RUTH LEACH Clerk of the Executive Council 1. Objective The objective of these Regulations is to prescribe those businesses that are exempted from the requirements for registration with a municipal council under section 366C of the Health Act 1958. 2. Authorising provisions These Regulations are made under sections 390(1) and 391 of the Health Act 1958. 3. Revocation The Health (Exempt Businesses) Regulations 2000 1 are revoked. -- 2 of 5 -- S.R. Exempt businesses For the purposes of section 366C(2) of the Health Act 1958, the following businesses are prescribed as exempt businesses— (a) the practice of a person registered under Part 2 of the Dental Practice Act 1999 in the dentists' division of the register; (b) the practice of a person registered as a medical practitioner under the Medical Practice Act 1994; (c) the practice of a person registered as a nurse under the Nurses Act 1993; (d) the practice of a person registered as a podiatrist under the Podiatrists Registration Act 1997; (e) the business of a collection centre for which approval has been granted under section 23DNBA of the Health Insurance Act 1973 of the Commonwealth; (f) the business of a pathology laboratory conducted on premises approved as an accredited pathology laboratory under section 23DN of the Health Insurance Act 1973 of the Commonwealth; (g) the business of a service where human tissue, human fluids or human body products are subjected to analysis for the purposes of the prevention, diagnosis or treatment of disease in human beings and that is not primarily a pathology service; (h) the business of a mobile hairdresser, except in relation to the principal place of business of the hairdresser; r. 4 -- 3 of 5 -- S.R. No. 93/2005 Health (Exempt Businesses) Regulations 2005 3 (i) the business of a mobile beautician or mobile beauty therapist, except in relation to the principal place of business of the beautician or beauty therapist; (j) the business of a public hospital, denominational hospital, private hospital, privately operated hospital, public health service, day procedure centre, multi purpose service or community health centre, within the meaning of the Health Services Act 1988. ═══════════════ r. 4 -- 4 of 5 -- S.R.
