No. 127/2005 Mental Health Act 1986 Mental Health (Amendment) Regulations 2005 The Governor in Council makes the following Regulations: Dated: 11 October 2005 Responsible Minister: BRONWYN PIKE Minister for Health RUTH LEACH Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend the Mental Health Regulations 1998 in relation to mental health practitioners. 2. Authorising provision These Regulations are made under section 142 of the Mental Health Act 1986. 3. Mental health practitioners For regulation 5(5) of the Mental Health Regulations 1998 1 substitute— '(5) For the purposes of the definition of "mental health practitioner" in section 7 of the Act, the prescribed class is those health service providers who are— (a) either— (i) registered nurses; or -- 2 of 4 -- S.R. No. 127/2005 Mental Health (Amendment) Regulations 2005 2 (ii) psychologists registered under section 6 of the Psychologists Registration Act 2000; or (iii) social workers; or (iv) occupational therapists; and (b) employed by a public sector mental health service within the meaning of section 120A of the Act that is an approved mental health service or a community mental health service; and (c) engaged in the provision of acute psychiatric assessment and treatment functions in the community.'. ═══════════════ r. 3 -- 3 of 4 -- S.R.
