Case law · Queensland · 2012
CITATION: Department of Education and Training Teachers' Certified Agreement 2010 (CA/2012/52) -Supplementary Decision <http://www.qirc.qld.gov.au> QUEENSLAND INDUSTRIAL RELATIONS COMMISSION Industrial Relations Act 1999 - s. 176 - requirements for other industrial action by an employee organisation or employees Queensland Teachers Union of Employees AND State of Queensland (Department of Education, Training and Employment) (CA/2012/52) DEPARTMENT OF EDUCATION AND TRAINING TEACHERS' CERTIFIED AGREEMENT 2010 DEPUTY PRESIDENT BLOOMFIELD 24 July 2012 SUPPLEMENTARY DECISION Background [1] On 13 July 2010 I issued a protected action ballot order pursuant to s. 176 and Schedule 4 of the Industrial Relations Act 1999 (the Act) in matter number CA/2012/52. [2] It has now come to my attention that the ballot order failed to include the requirement for Queensland Teachers Union of Employees (QTU) to provide the Department of Education, Training and Employment (DETE) with five working days' notice of industrial action if the ballot of QTU Members authorised the Union to take industrial action. [3] This period of notice had been decided as being appropriate (see s. 176(6)(b) and Schedule 4 - ss. 8(4) and (5) of the Act) in a decision issued on 11 July 2012 in a related proceeding in matter number CA/2012/47. [4] In the circumstances I propose to act, pursuant to s. 329(e) of the Act, to correct the Order I issued on 13 July 2012 to include a provision which contains the period of notice which QTU is to provide to DETE prior to its Members taking industrial action in support of the Union's claims for a new enterprise agreement. [5] A corrected Order is attached to this Supplementary decision. [6] Order accordingly. A.L. BLOOMFIELD, Deputy President. Released: -- 1 of 1 --
