REPORT ON DECISION (as edited)
In giving her Decision from the Bench on 29 June 2012, Commissioner Fisher stated:
"This is an application by Richard Greenwood, Senior Vice President and Richard Barnes, Secretary/Treasurer of
the Australian Maritime Officers Union Queensland Union of Employees (AMOUQ) seeking to amend the
eligibility rule of the organisation pursuant to s. 474 of the Industrial Relation Act 1999.
A copy of an advertisement placed in the 'Courier-Mail' of 9 May 2012 giving notice of the proposed amendment
was provided. In addition an Affidavit of Service sworn by Kathryn Rogers, Secretary, Hall Payne Lawyers, was
also provided attesting to the service of the Notice on industrial organisations of employees nominated by the Acting
Industrial Registrar. No industrial organisation has notified an objection to the proposed amendment.
From the information sworn by Mr Greenwood and Mr Barnes in the application and the submissions made, the
Queensland Industrial Relations Commission (the Commission) is satisfied that the amendment has been proposed
in accordance with Rule 198 of the Industrial Relations (Tribunals) Rules 2011. Further, the application complies
with Regulation 18 of the Industrial Relations Regulation 2011 in that a copy of the notice was served on those
organisations whose callings include the callings of the applicant's members or relate to the applicant's eligibility
rules.
In view of the above the Commission approves the eligibility rule amendment with effect from today, 29 June 2012.
The Commission will notify the Industrial Registrar of this order approving the amendment so that the particulars of
the amendment can be entered in the register.".
