I set aside the Case Stated. I affirm that on the current state of the authorities, the status quo position is that s. 320 of the Industrial Relations Act 1999 does vest the Queensland Industrial Relations Commission (the Commission) and an Industrial Magistrate with the authority to grant interested parties leave to be heard (as a matter of discretion) and subject to such restrictions as the Commission or Industrial Magistrate thinks fit.".
