No. 83/2005 Surveillance Devices Act 1999 Surveillance Devices Regulations 2005 The Lieutenant-Governor as the Governor's Deputy with the advice of the Executive Council makes the following Regulations: Dated: 5 July 2005 Responsible Minister: ROB HULLS Attorney-General RUTH LEACH Acting Clerk of the Executive Council 1. Objective The objective of these Regulations is to prescribe positions and classes of employees for the purposes of certain definitions in the Surveillance Devices Act 1999. 2. Authorising provision These Regulations are made under section 37A of the Surveillance Devices Act 1999. 3. Commencement (1) These Regulations, other than regulation 6, come into operation on 5 July 2005. (2) Regulation 6 comes into operation on the day on which section 5(1)(j) of the Surveillance Devices (Amendment) Act 2004 comes into operation. -- 2 of 4 -- S.R. Prescribed members of staff of the Office of Police Integrity For the purposes of the definition of "prescribed member of staff of the Office of Police Integrity" in section 3(1) of the Surveillance Devices Act 1999 the following positions and classes of employees are prescribed— (a) the position of Deputy Director, Police Integrity; (b) the position of Assistant Director, Police Integrity; (c) employees in the Office of Police Integrity classified as non-executive employees Grade 4, 5 or 6 or Senior Technical Specialist. 5. Senior law enforcement officers in the Office of Police Integrity For the purposes of paragraph (ba)(ii) of the definition of "senior law enforcement officer" in section 3(1) of the Surveillance Devices Act 1999 the following positions are prescribed— (a) the position of Deputy Director, Police Integrity; (b) the position of Assistant Director, Police Integrity. r. 4 -- 3 of 4 -- S.R. No. 83/2005 Surveillance Devices Regulations 2005 3 6. Regulation 5 substituted For regulation 5 of these Regulations substitute— '5. Senior officers in the Office of Police Integrity For the purposes of paragraph (e)(ii) of the definition of "senior officer" in section 3(1) of the Surveillance Devices Act 1999 the following positions are prescribed— (a) the position of Deputy Director, Police Integrity; (b) the position of Assistant Director, Police Integrity.'. ═══════════════ r. 6 -- 4 of 4 --
