No. 97/2005 Teaching Service Act 1981 Teaching Service (Appeals) Regulations 2005 The Governor in Council approves the making of the following Regulations by the Acting Minister for Education and Training: Dated: 2 August 2005 Responsible Minister: LYNNE KOSKY Minister for Education and Training RUTH LEACH Clerk of the Executive Council The Acting Minister for Education and Training makes the following Regulations: Dated: 5 August 2005 JACINTA ALLAN Acting Minister for Education and Training 1. Objective The objective of these Regulations is to prescribe a new form for use in making an appeal to a Merit Protection Board or a Disciplinary Appeals Board. 2. Authorising provision These Regulations are made under section 78 of the Teaching Service Act 1981. -- 2 of 5 -- S.R. No. 97/2005 Teaching Service (Appeals) Regulations 2005 2 3. Revocation The Teaching Service (Merit Protection Board) (Appeal) Regulations 19941 are revoked. 4. Prescribed form for notices of appeal For the purposes of sections 45A(3)(b) and 74(3)(b) of the Teaching Service Act 1981, the form set out in the Schedule is prescribed. __________________ r. 3 -- 3 of 5 -- S.R. No. 97/2005 Teaching Service (Appeals) Regulations 2005 3 SCHEDULE Regulation 4 NOTICE OF APPEAL Merit Protection Board/Disciplinary Appeals Board* (Insert address of relevant Board here) APPELLANT: (Insert name of Appellant here) 1. Under section 45A of the Teaching Service Act 1981, the Appellant appeals against a determination of the Secretary made under section 45(1) of that Act dated (insert date of determination).* 1. Under section 74 of the Teaching Service Act 1981, the Appellant appeals against a determination of the Secretary made under section 67 of that Act dated (insert date of determination).* (Attach a copy of the notice of the determination received from the Secretary) 2. The Appellant's reasons for appealing against the determination are as follows— (Insert details of reasons for appealing the determination) 3. The Appellant wishes/does not wish* to be represented by another person at the hearing of the appeal.
