Case law · Queensland · 2007
[Extract from Queensland Government Industrial Gazette, dated 5 April, 2007, Vol. 184, No. 14, page 203] INDUSTRIAL COURT OF QUEENSLAND Electrical Safety Act 2002 - s. 172 - appeal against issue of improvement notice Colin Bailey Trading as Bailey’s Electrical and Building Services AND Allan John Dall (No. 2) (C/2004/77) AND Colin Bailey Trading as Bailey’s Electrical and Building Services AND Allan John Dall (No. 2) (C/2004/79) PRESIDENT HALL 26 March 2007 REPORT ON DECISION (as edited) In giving a decision from the Bench on 14 March 2007, the President stated: "I am asked to reopen/revisit a decision under the Electrical Safety Act 2002, delivered on 7 April 2005 (see 178 QGIG 399). It seems to me that the absence of jurisdiction to deal with this matter is patent. It may be that this Court could revisit something in the nature of an error which would attract the operation of the 'slip rule'. This case is not about such errors. I am obliged under the law to dismiss the purported application and I do.". Dated 26 March 2007. By the Court, [L.S.] G.D. SAVILL, Industrial Registrar. Released: 26 March 2007 Appearances: The Appellant in person. Mr P. Matthews of the Electrical Safety Office, for the Respondent. Government Printer, Queensland The State of Queensland 2007. -- 1 of 1 --
