Crimes (Procedure) Regulations 2004
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to prescribe
periods for the purposes of section 353(2) and (3)
of the Crimes Act 1958.
2. Authorising provision
These Regulations are made under section 505A
of the Crimes Act 1958.
3. Commencement
These Regulations come into operation on
5 September 2004.
4. Revocation
The Crimes (Procedure) Regulations 1994 1 are
revoked.

5. Prescribed period under section 353(2) of the
Crimes Act 1958
For the purposes of section 353(2) of the Crimes
Act 1958, the prescribed period is 6 months from
the date of committal.
6. Prescribed period under section 353(3) of the
Crimes Act 1958
For the purposes of section 353(3) of the Crimes
Act 1958, the prescribed period is 12 months from
the date of committal.
7. Transitional provisions
(1) These Regulations only apply to a person
committed for trial on or after 5 September 2004.
(2) Despite their revocation, the Crimes (Procedure)
Regulations 1994 continue to apply if the date of
committal was before 5 September 2004.
