In my view, because the decision was announced at a hearing, time runs from the announcement of the decision rather than from the subsequent release of a written decision. That said, the period of delay (seven days) is very short. There is no apparent prejudice to the other parties in that the issues raised are allegedly errors of law. Given that there is presently a reserved decision dealing with one of the issues to be argued on the appeal, I am not in a position at this stage to say that the appeal is not arguable. I extend time. I do note what is said by Mr Sapsford for Q-COMP. In the event that the reserved matter of Australia Meat Holdings Pty Ltd v Kennedy (C/2006/7) is decided in a particular way, the appellant is on notice that, if the appellant is unsuccessful on the hearing of the appeal, an application for costs may well flow from what was said by Mr Sapsford today.".
