Drugs, Poisons and Controlled Substances
(Division 2 Nurses Amendment) Regulations 2004
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to include
persons registered in division 2 of the register of
nurses kept in accordance with section 17 of the
Nurses Act 1993, whose registration is endorsed
under section 8C of that Act, in the definition of
"nurse" in the Drugs, Poisons and Controlled
Substances Regulations 1995 for the purposes of
those Regulations.
2. Authorising provisions
These Regulations are made under sections 129,
132 and 132B of the Drugs, Poisons and
Controlled Substances Act 1981.

3. Definition
In regulation 4 of the Drugs, Poisons and
Controlled Substances Regulations 19951 , for the
definition of "nurse" substitute—
' "nurse" means—
(a) a person registered in division 1,
division 3 or division 4 of the register
of nurses established under the Nurses
Act 1993;
(b) a person registered in division 2 of that
register whose registration is endorsed
under section 8C of that Act;'.
