No. 58/2004 Electricity Safety Act 1998 Electricity Safety (Installations) (Amendment) Regulations 2004 The Governor in Council makes the following Regulations: Dated: 8 June 2004 Responsible Minister: THEO THEOPHANOUS Minister for Energy Industries DIANE CASEY Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend the definitions of "hazardous bushfire risk area" and "low bushfire risk area" in the Electricity Safety (Installations) Regulations 1999. 2. Authorising provisions These Regulations are made under sections 152 and 157 of the Electricity Safety Act 1998. -- 2 of 5 -- Victorian Legislation and Parliamentary Documents S.R. Bushfire risk areas (1) In regulation 401(1) of the Electricity Safety (Installations) Regulations 19991— (a) for paragraph (f) substitute— "(f) after clause 1.4.55 insert— '1.4.55A Hazardous bushfire risk area An area— (a) that a fire control authority has assigned a fire hazard rating of "high" under section 80 of the Electricity Safety Act 1998; or (b) that is not an urban area within the meaning of section 3 of that Act unless a fire control authority has assigned to that area a fire hazard rating of "low" under section 80 of that Act.';"; (b) for paragraph (h) substitute— "(h) after clause 1.4.59 insert— '1.4.59A Low bushfire risk area An area— (a) that a fire control authority has assigned a fire hazard rating of "low" under section 80 of the Electricity Safety Act 1998; or (b) that is an urban area within the meaning of section 3 of that Act.';". r. 3 -- 3 of 5 -- Victorian Legislation and Parliamentary Documents S.R. No. 58/2004 Electricity Safety (Installations) (Amendment) Regulations 2004 3 (2) For regulation 403(3)(b) of the Electricity Safety (Installations) Regulations 1999 substitute— '(b) "low bushfire risk area" means— (i) an area that a fire control authority has assigned a fire hazard rating of "low" under section 80 of the Act; or (ii) an urban area within the meaning of section 3 of the Act.'. ═══════════════ r. 3 -- 4 of 5 -- Victorian Legislation and Parliamentary Documents S.R.
