Croft v Chubb Security Australia Pty Ltd (No. 2) [2005] QIRC 57 (2005) 179 QGIG 22
[Extract from Queensland Government Industrial Gazette,
dated 13 May, 2005, Vol.179, No.2, page 22]
QUEENSLAND INDUSTRIAL RELATIONS COMMISSION
Industrial Relations Act 1999 – s. 335 – application for costs
Peter Anthony Croft AND Chubb Security Australia Pty Ltd (No. 2) (No. B1364 of 2003)
DEPUTY PRESIDENT BLOOMFIELD 3 May 2005
Application for costs – Costs awarded – Schedule of Costs for consideration – Payment within 14 days.
DECISION
On 31 March 2005 I issued a decision (now published at 178 QGIG 361) in which I found that the circumstances of this
case dictated that I award Mr Peter Anthony Croft (the applicant) costs in respect of his application for reinstatement.
In doing so, I directed the applicant’s solicitors to prepare a schedule of costs within 14 days of release of the decision
for consideration by the respondent’s representative. I also ordered the parties to confer about the amount of costs, with
recourse back to the Commission if the parties could not agree on the quantum.
Although the steps set out above took longer to conclude than the Commission had originally directed, correspondence
has now been received from solicitors for the applicant and the representative of the respondent, respectively, which
advise that agreement has been reached on the amount of costs to be paid to the applicant.
Accordingly, in circumstances where the parties now agree on such quantum, I formally order that Chubb Security
Australia Pty Ltd make payment to Mr Peter Anthony Croft of the amount of $19,480 within 14 days of the date of
release of this decision.
The Commission determines and orders accordingly.
A.L. BLOOMFIELD, Deputy President.
