HIS HONOUR: This is an application by Ian David Jessup, the
Court appointed receiver of the first respondent and the
fourth respondent, seeking the public examination of certain
persons pursuant to sections 596A and 596B of the Corporations
Act .
HIS HONOUR: The applicant has been authorised by Australian
Securities and Investment Commission to conduct the public
examination by letter, dated the 17th of October 2003 (Exhibit
IDJ1 ).
In his two affidavits, Mr Jessup has identified the persons
whom he wishes to examine and the role that each of those
persons has played in the affairs of the respondents of which
he is the receiver.
The application for the examination of Virginia Lee Ranson-
Walters must be made pursuant to 596A, as she is an examinable
officer of the corporation under administration.
HIS HONOUR: I am satisfied that the examination of each of
the individuals referred to in the affidavit of Mr Jessup is
appropriate for the reasons which he outlines.
