HIS HONOUR; This is an application for substituted service of
an originating application and supporting affidavit on the
respondent who is a resident of Germany. The respondent has
however retained solicitors and Mr Philp of counsel, appearing
on behalf of the respondent, has raised no objection to
substituted service being made by service of the relevant
documents upon those solicitors. That agreement however is
subject to a copy of those relevant documents being delivered
in the German language. Mr Bruderle is prepared to satisfy
that condition.
Consequently, I make the following order: That service on the
respondent will be effected by the delivery of the originating
application, and the affidavit of Diethardt Bruderle, filed on
30th of July 2003, to the office of Morrow Petersen at the
ground floor of the Corporate Tower, Lake Street, Cairns,
together with a copy of such documents in the German language.
Such documents will include an address for service for the
applicant within the city of Cairns.
Costs of and incidental to this application will be reserved.
