W64 and W65 of 2003) COMMISSIONER ASBURY 23 October 2003 REPORT ON DECISION (as edited) In giving her decision from the Bench on 18 August 2003, Commissioner Asbury said: “Having considered the material in relation to service of the applications, and in particular the fact that the applications were served on the Respondents; that they contained the appropriate warnings that the matter could be dealt with in their absence if they chose not to appear or be represented; and also in light of the fact that there has been no apparent effort of the Respondents to comply with any of the directions of the Commission in relation to this matter or to advise the Commission as to why those Directions Orders have not been complied with or to seek leave of the Commission to amend the Directions Orders; I am satisfied that the requirements to deal with the applications on an ex parte basis under the rules have been met and accordingly I will deal with them on that basis. With respect to W64 of 2003, I order that the Respondents pay to Nicole Maree Thew the sum of $4,821.55. I order that this sum be paid to the Queensland Department of Industrial Relations within 21 days of the release of this Decision. With respect to W65 of 2003, I order that the Respondents pay to David Lee the sum of $3,090.45. I order that this sum be paid to the Queensland Department of Industrial Relations within 21 days of the release of this Decision. Further, I order that the Respondents make contact with the Department of Industrial Relations to arrange for these payments to be made and that the Department of Industrial Relations initiate contact with the Respondents to determine the manner of payment.”.
