No. 105/2004 Occupational Health and Safety Act 1985 Occupational Health and Safety (Mines) (Amendment) Regulations 2004 The Governor in Council makes the following Regulations: Dated: 10 August 2004 Responsible Minister: ROB HULLS Minister for WorkCover DIANE CASEY Clerk of the Executive Council 1. Objectives The objectives of these Regulations are— (a) to amend the Occupational Health and Safety (Mines) Regulations 2002 by providing that the use of sodium cyanide in mines is a mining hazard; and (b) to make consequential amendments to the Occupational Health and Safety (Major Hazard Facilities) Regulations 2000. 2. Authorising provision These Regulations are made under section 59 of the Occupational Health and Safety Act 1985. 3. Commencement These Regulations come into operation on 13 August 2004. -- 2 of 4 -- Victorian Legislation Parliamentary Documents S.R. Occupational Health and Safety (Mines) Regulations 2002 In regulation 104(1) of the Occupational Health and Safety (Mines) Regulations 20021 , in the definition of "mining hazard", after paragraph (p) insert— "(pa) exposure to sodium cyanide and its reaction products;". 5. Occupational Health and Safety (Major Hazard Facilities) Regulations 2000 (1) In Schedule 1 to the Occupational Health and Safety (Major Hazard Facilities) Regulations 20002 , in the Notes to Table 2, after clause 2 and the table immediately following that clause insert— '3. "Toxic Solids and liquids" do not include— (a) materials which are classified as Infectious Substances (Class 6.2) or as Radioactive (Class 7); or (b) in relation to "mines" within the meaning of the Occupational Health and Safety (Mines) Regulations 2002, sodium cyanide.'. (2) In Table 2 of Schedule 1 to the Occupational Health and Safety (Major Hazard Facilities) Regulations 2000, in the item relating to "Toxic Solids and liquids" omit "(other than materials which are classified as Infectious Substances (Class 6.2) or as Radioactive (Class 7))". ═══════════════ r. 4 -- 3 of 4 -- Victorian Legislation Parliamentary Documents S.R.
