Facsimile: (07) 3247 5532 -- 1 of 2 -- 21052001 T4/MFK M/T CNSl/2001 (Jones J) HIS HONOUR: This is an application on the part of the plaintiff to consolidate two actions which were instituted in respect of one incident where the plaintiff alleges that he sustained injuries in a workplace accident. The second of those two actions was instituted because of uncertainty concerning the construction of certain provisions of the WorkCover Act. Those uncertainties have now been resolved by Court decisions, and so it is appropriate that the actions be consolidated rather than having unnecessary proceedings in place. The plaintiff suffered injuries in an earlier motor vehicle incident, in respect of which he commenced proceedings. The parties have sought that the consolidated action be heard together with that action so that the appropriate apportionment of damage to the two incidents can be made. Each of the parties are prepared to consent to this course being followed. Accordingly I will make the orders by consent in terms of the draft initially by me and placed with the papers. 2 JUDGMENT 20 -- 2 of 2 --
