SUPREME COURT OF QUEENSLAND CIVIL JURISDICTION MUIR J No 2674 of 2001 EASTLINK PROPERTIES PTY LTD ACN 070 548 257 and REVISED COPIES ISSUED State Reporting Bureau Date tO I Cf I o , Plaintiff/Applicant HEALTHLAND INTERNATIONAL LIMITED First Defendant/Respondent and HEALTHLAND EUROPE LIMITED Second Defendant BRISBANE .. DATE 04/04/2001 JUDGMENT Floor, The Law Courts, George Street, Brisbane, a. 4000 Telephone: (07) 3247 4360 Fax: (07) 3247 5532 -- 1 of 2 -- 04042001 T16/JAP22 M/T 3/2001 (Muir J) HIS HONOUR: When this matter came on for hearing the first defendant was called and there was no appearance. Correspondence from the administrator of the second defendant reveals that he does not consent to or oppose the relief sought. The matters set out in paragraphs 26 to 31 inclusive of Mr Sweeney's detailed submissions satisfy me that the circumstances are such that I am justified on the authorities in making the orders sought. If, at any time, the defendants wish to have those orders varied or discharged they will be at liberty to apply to that end. Mr Sweeney, I will insert in paragraph 4 of the order "the parties have liberty to apply" and paragraph 4 will become 5. MR SWEENEY: Thank you, your Honour. HIS HONOUR: With those variations I order in terms of the draft initialled by me. 2 JUDGMENT l 10 20 30 4 5 6 -- 2 of 2 --
