No. 129/2004 Prostitution Control Act 1994 Prostitution Control (Fees) Regulations 2004 The Governor in Council makes the following Regulations: Dated: 26 October 2004 Responsible Minister: JOHN LENDERS Minister for Consumer Affairs DIANE CASEY Clerk of the Executive Council PART 1óPRELIMINARY 1. Objective The objective of these Regulations is to prescribe fees to be paid under the Prostitution Control Act 1994. 2. Authorising provisions These Regulations are made under sections 68 and 90 of the Prostitution Control Act 1994. 3. Commencement These Regulations come into operation on 1 November 2004. -- 2 of 8 -- Victorian Legislation Parliamentary Documents Part 1óPreliminary Prostitution Control (Fees) Regulations 2004 S.R. Definitions In these Regulationsó "business name" means a name, style, title or designation under which a business is carried on; "the Act" means the Prostitution Control Act 1994. __________________ r. 4 -- 3 of 8 -- Victorian Legislation Parliamentary Documents Part 2óFees Prostitution Control (Fees) Regulations 2004 S.R. No. 129/2004 3 PART 2óFEES 5. Licence application fees For the purposes of section 33(2)(d)(i) of the Act, the application fee for a licence to carry on business as a prostitution service provideró (a) in relation to a brothel is 342∑13 fee units; (b) in relation to an escort agency is 171∑07 fee units; and (c) in relation to both a brothel and an escort agency is 342∑13 fee units. 6. Licence fees and annual licence fees The licence fee for the purposes of section 33(2)(d)(ia) of the Act and the annual licence fee for the purposes of section 46A(1) of the Act, for a licence to carry on business as a prostitution service provider isó (a) in relation to a brothel, the sum ofó (i) 195∑50 fee units; and (ii) if more than one room is to be used or is used for prostitution, 36∑66 fee units for each additional room; and (iii) if more than one business name is to be used or is used in carrying on the business, 36∑66 fee units for each additional business name; and (b) in relation to an escort agency, the sum ofó (i) 195∑50 fee units; and (ii) if more than one telephone number is to be used or is used in carrying on the business, 36∑66 fee units for each additional telephone number; and r. 5 -- 4 of 8 -- Victorian Legislation Parliamentary Documents Part 2óFees Prostitution Control (Fees) Regulations 2004 S.R. No. 129/2004 4 (iii) if more than one business name is to be used or is used in carrying on the business, 36∑66 fee units for each additional business name; and (c) in relation to both a brothel and an escort agency, the sum ofó (i) 195∑50 fee units; and (ii) if more than one room is to be used or is used for prostitution, 36∑66 fee units for each additional room; and (iii) if more than one telephone number is to be used or is used in carrying on the business, 36∑66 fee units for each additional telephone number; and (iv) if more than one business name is to be used or is used in carrying on the business, 36∑66 fee units for each additional business name. 7. Extension of time and late payment fees (1) For the purposes of section 46B of the Act, the required fee― (a) for an extension of time is 14∑66 fee units; (b) for a further extension of time is 14∑66 fee units. (2) For the purposes of section 46C of the Act― (a) the required late payment fee is 29∑33 fee units; (b) the required late lodgement fee is 29∑33 fee units. r. 7 -- 5 of 8 -- Victorian Legislation Parliamentary Documents Part 2óFees Prostitution Control (Fees) Regulations 2004 S.R. Application fee for approval of manager For the purposes of section 50(2) of the Act, the application fee is 25∑42 fee units. __________________ r. 8 -- 6 of 8 -- Victorian Legislation Parliamentary Documents Part 3óTransitional Provisions Prostitution Control (Fees) Regulations 2004 S.R. No. 129/2004 6 PART 3óTRANSITIONAL PROVISIONS 9. Old licence fee payable before 13 December 2004 Despite regulation 6, the annual licence fee for the purposes of section 46A(1) of the Actó (a) in respect of a licence that has an anniversary date before 13 December 2004; and (b) that is paid on or after 1 November 2004 in accordance with section 46A(2) of the Actó is the licence fee referred to in regulation 13 of the Prostitution Control Regulations 19951 as in force on 31 October 2004. 10. Old approval fee payable before 1 May 2005 Despite regulation 8, the application fee for the purposes of section 50(2) of the Actó (a) in respect of an application for a renewal of an approval under section 50(1) of the Act that expires before 1 May 2005; and (b) that is paid on or after 1 November 2004 in accordance with section 50(3) of the Actó is the fee that would have been payable in respect of the application under regulation 17 of the Prostitution Control Regulations 19952 as in force on 31 October 2004. ═══════════════ r. 9 -- 7 of 8 -- Victorian Legislation Parliamentary Documents Prostitution Control (Fees) Regulations 2004 S.R.
