No. 48/2004 Road Safety Act 1986 Road Safety (Drivers) (Demerit Points) Regulations 2004 The Governor in Council makes the following Regulations: Dated: 18 May 2004 Responsible Minister: PETER BATCHELOR Minister for Transport STEPHANIE LENN Acting Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend the Road Safety (Drivers) Regulations 1999 to provide for— (a) the cancellation of demerit points for alleged speeding offences on the Western Ring Road detected by the prescribed detection device known as the Poltech SafeCam Mk 1; and (b) the cancellation of other demerit points in certain circumstances. 2. Authorising provisions These Regulations are made under sections 25(5) and 95 of the Road Safety Act 1986. -- 2 of 5 -- Victorian Legislation Parliamentary Documents S.R. No. 48/2004 Road Safety (Drivers) (Demerit Points) Regulations 2004 2 3. New regulation 302A inserted After regulation 302 of the Road Safety (Drivers) Regulations 1999 1 insert— '302A. Cancellation of certain demerit points (1) The Corporation must cancel a demerit point recorded in the Demerits Register against a person if the Secretary to the Department of Justice notifies the Corporation in writing that— (a) the point was incurred in relation to an alleged offence against Road Rule 20 that occurred on the Western Ring Road before the relevant day; and (b) the alleged offence was detected by a prescribed detection device of the kind referred to in regulation 302(f) of the Road Safety (General) Regulations 19992 . (2) If— (a) the Corporation has served a notice on a person under section 25(3) of the Act; and (b) one or more of the demerit points in respect of which the notice was issued is cancelled in accordance with sub- regulation (1)— the Corporation must cancel all of the demerit points recorded in the Demerits Register against the person as at the date of issue of the notice. r. 3 -- 3 of 5 -- Victorian Legislation Parliamentary Documents S.R.
