31 March, 2000 QUEENSLAND GOVERNMENT INDUSTRIAL GAZETTE 403 ########################################################################################################################### INDUSTRIAL COURT OF QUEENSLAND Industrial Relations Act 1999 – s. 341(2) – appeal against decision of industrial magistrate Victor Borghero AND Mark Lyle Nominees Pty Ltd (C78 of 1999) PRESIDENT HALL 17 March 2000 REPORT ON DECISION (as edited) In giving his decision from the Bench on 14 March 2000, President Hall stated:– “On 13 March 2000 in matter C75 of 1999 I allowed an appeal relating to one of two complaints pressed by Victor Borghero at the Industrial Magistrates Court at Holland Park. This appeal relates to the second of those complaints. Regrettably it was not listed for hearing at the same time as matter C75 of 1999. It is understood by all parties that it is inevitable that this matter must take the same course as the earlier appeal. In those circumstances I allow the appeal. I adjourn the Court.” Dated this seventeenth day of March, 2000. By the Commission, [L.S.] E. Ewald, Industrial Registrar. Appearances:– Mr C. Murdoch instructed by the Crown Solicitor for the appellant. Ms K. Prior of Prior and Associates for the respondent.
