DATE 17/05/99 ) JUDGMENT 1 -- 1 of 2 -- 170599 D.1 T6/CH M/T CNS394/99 (Jones J) HIS HONOUR: This is an application for the appointment of ·a provisional liquidator to the incorporated as~ociation, Cairns Career Training Inc. The association stopped trading on 16 April 1999. The board of management at that time had effectively disbanded and as a consequence there is no person actively pursuing the interests of either the association or the creditors of the association. Mr Anthony Jonsson, accountant of Horwaths Cairns, was asked to prepare a report of financial status of the association and came to the view that the association was insolvent and should not continue trading. An application for the winding-up of the association was filed on 14 May 1990 and this application now seeks the appointment of a provisional liquidator to protect the assets of the association pending that winding-up. It is appropriate that such an appointment be made. Mr Ian David Jessop has consented to being appointed as provisional liquidator.
