The Commission understands that the parties have had extensive discussions regarding this application. As I understand the effect of the application, it is that hire rates of vehicles would be reduced, but the wages of the people concerned would remain unchanged. Although the impact is noted, in my view the fact that the ordinary time earnings of owne r -driver� would not be affected is significant. 1 also note Mr Thompson's submissions that in 1992 there was some broad agreement between the AWU and others concerning the remo,·al of non reduction rates. From the submissions made by the AWU this mor ning it would seem to recognise that particular co nsequences are likely to flow in the event that non-reduction rates remain in this award. Bearing all this i n mind. I have none the less decided that the Council has made out its case. Accordingly. I propose to vary the award in accordance with the am�nded application submitted today.
