"This is an application by Agforce Que ensland for regiStration as an employer organisation under the /11duJtrial Orga11isatio1is Acr 1997. There are no objectors. At an earl ier stage, cenain correspondence was exchanged betw een the Industrial Registrar and the applicant in relation to its rules. The rules hav e now been so amended as to substantially overcome the difficulties raised. Some difficulties remain. They are dif:ficulttes 10 the sense that they raise difficult points of construction both of the Act and of the mles . However, the c1rcums1ance that there is some room for doubt is not significant. In proceedings such as this, unless there is a clear case of nonconformity the proper cour se 1s to conclude that the rul es do comply with the Act and to approve the rules, see re: MOA. ATOFF and TSG amalgamation 38 IR 13 at page 14 per Moore, Deputy President. In those circumstances, I approve the rules. The criteria at section 10 are satisfied. There is no material whatever before me on the basis of which one cou ld co nclude that section 187 is triggered. In those circumstances, I grant the application f or registration.".
