No. 67/2004 Tertiary Education Act 1993 Tertiary Education (Fees) Regulations 2004 The Governor in Council makes the following Regulations: Dated: 22 June 2004 Responsible Minister: LYNNE KOSKY Minister for Education and Training DIANE CASEY Clerk of the Executive Council 1. Objective The objective of these Regulations is to prescribe fees for the purposes of the Tertiary Education Act 1993. 2. Authorising provision These Regulations are made under section 22 of the Tertiary Education Act 1993. 3. Commencement These Regulations come into operation on 27 June 2004. 4. Definitions In these Regulations— "self-accrediting provider" means an institution specified in Schedule 1 to the Act, an institution approved to operate as a university under section 10 of the Act or the Melbourne College of Divinity; "the Act" means the Tertiary Education Act 1993. 6. Endorsement of courses of study for overseas students (1) The fees for the investigation of applications under section 6(2) of the Act by post-secondary education providers are set out in Table 1 in the Schedule. (2) The fee for the investigation of an application from an institution that is not a self-accrediting provider is the fee set out in column 2 of Table 1 in the Schedule for the level of the course. (3) The fee for the investigation of an application from a self-accrediting provider is the fee set out in column 3 of Table 1 in the Schedule for the level of the course. (4) If applications are received at the same time that relate to two or more courses in the same detailed field of study that can be investigated at the same time by an assessment panel established with expertise in that detailed field of study, the fee is the fee payable in column 2 of Table 1 for the highest level of the course to be investigated in that detailed field of study. r. 5 -- 3 of 9 -- Victorian Legislation Parliamentary Documents S.R. Accreditation of higher education courses of study (1) The fee for the investigation of an application under section 11(2) of the Act for accreditation of a higher education course of study is the fee set out in column 2 of Table 2 in the Schedule for the level of the course. (2) If applications are received at the same time that relate to two or more courses in the same detailed field of study that can be investigated at the same time by an assessment panel established with expertise in that detailed field of study, the fee payable is the total of— (a) the fee payable in column 2 of Table 2 for the highest level of the course to be investigated in that detailed field of study; and (b) the fee payable in column 3 of Table 2 for the level of each additional course to be investigated in that detailed field of study. 8. Authorisation to conduct higher education courses of study (1) The fee for the investigation of an application under section 11(2) of the Act for authorisation to conduct a higher education course of study is the fee for the level of the course of study set out in column 2 of Table 3 in the Schedule. (2) If applications are received at the same time that relate to two or more courses in the same detailed field of study that can be investigated at the same time by an assessment panel established with expertise in that detailed field of study, the fee is that for the highest level of the course to be investigated in that detailed field of study. r. 7 -- 4 of 9 -- Victorian Legislation Parliamentary Documents S.R.
