144 QUEENSLAND GOVERNMENT INDUSTRIAL GAZETTE 19 February, 1999 19 February, 1999 QUEENSLAND GOVERNMENT INDUSTRIAL GAZETTE 145 QUEENSLAND INDUSTRIAL RELATIO.N"S COMMISSIOJ\ Workplace Relations Act 1997 - s. 121 - application for variation Australian Liquor, Hospitality and Miscellaneous Workers Cnion, Queensland Branch, Union of Employees AND Queensland Chamber of Commerce and Industry Limited, Industrial Organisation of Employers (No. B985 of 1997) GRAIN AND ASSOCIATED PRODUCTS MILLING AWARD-SOUTHERN DIVISION COMMISSIONER BALDWIN VARIATION 11 December 1998 THIS matter coming on for hearing before the Commission at Brisbane on 11 December 1998, this Commission doth order that the said Award be varied as follows as from the eleventh day of December, 1998:- 1. By deleting clause 3.2 (Guaranteed Minimum Wage) and inserting a new clause 3.2 (Queensland Minimum Wage) as follows:- "3.2Queensland Minimum Wage (1) No employee shall be paid less than the Queensland minimum wage. (2) Amount of Queensland Minimum Wage: (a) The Queensland minimum wage for full-time adult employees not covered by suhclause (4) [Special Categories) is $373.40 per week; (b) Adults employed under the Supported Wage Award - State shall continue to be entitled to receive the wage rate determined under that Award: Provided that such employees shall not be paid less than the amount determined by applying the percentage in the Supported Wage Award - State applicable to the employee concerned to the amount of the minimum wage specified in subclause (2)(a); and (c) Adults employed as part-time or casual employees shall continue to be entitled to receive the wage rate determined under the casual and part-time clauses of the Award: Provided that such employees shall not be paid less than pro rata the minimum wage specified in suhclause (2)(a) according to the number of hours worked. (3) How the Queensland Minimum Wage Applies to Juniors: (a) The wage rate provided for juniors by this Award continue to apply unless the amount determined under subclause (3)(h) is greater; and (b) The Queensland minimum wage for an employee to whom a junior rate of pay applies is determined by applying the percentage in the junior wage rates clause applicable to the employee concerned to the relevent amount in subclause (2). -- 1 of 2 -- 146 QUEENSLAND GOVERNMENT INDUSTRIAL GAZETfE 19 February, 1999 (4) Application of Minimum Wage to Special Categones of Employee: (a) This clause has no application lo employees. undertaking a State Training Wage A ward Traineesh1p, an Australian Traineeship .. a Career Start Trainecship, a Jobskills placement, a tramee covered by any Order of the Queensland Industrial Relations Commission made under the Vocational Education, Trai,iing and Employment Act 1991 (or successor legislation) or an apprenticeship (whether covered by an award, industnal agreement, certified agreement, currently operatmg enterprise flexibility agreement, Queensland wrnkplace agreement, or Order of the Queensland Industrial Relations Commission: and (b) Leave reserved for special categories. (5) Application of Queensland Minimum Wage to Award Rates Calculation: The Queensland \iinimum Wage: (a) Awlie.s to all work in ordinary hours: (b) Awlies to lhe calculation of owrtime and all other penalty rates, superannuation, payments during sick leave, long service leave and annual leave, and for all other purposes of this A ward; and (c) Is inclusive of the $14 per week arbitrated safety net ad3ustment granted by The Declaration of General Ruling of 25 August 1998 and all previous safety net and State Wage adjustments.". 2. Where an employee has received a wage increase in excess of the total $34 Safety Net Adjustments made aYailable since 1 Fcbrnary 1992, that increase may be set off against the wage rate prescribed in this Award. The payments which niay be set off include wages payable pursuant to certified agreemen~. cuffently operating enterprise flexibility agreements, Queensland workplace agreements, awMd variations to give effect to enterprise agreements and overaward arrangements. Absorption which is contrary to the terms of an agreement 1s not reqrnred. Increases made under previous State Wage Case decisions or under the current Statement of Principles, excepting tlwse resulting from enterprise agreements, are not to be used to offset arbitrated Safety Net Adjustments." 3.
