Associations Incorporation (Amendment)
Regulations 2003
The Governor in Council makes the following Regulations:

1. Objectives
The objectives of these Regulations are to amend
the Associations Incorporation Regulations 1998
to—
(a) prescribe further particulars for the purposes
of sections 5, 10(3)(c), 31(3)(c) and 31(3)(d)
of the Associations Incorporation Act
1981; and
(b) update the name of an accounting body; and
(c) prescribe new offences for which a penalty
notice can be issued.
2. Authorising provision
These Regulations are made under section 54 of
the Associations Incorporation Act 1981.

3. Commencement
These Regulations come into operation on
1 November 2003.
4. Principal Regulations
In these Regulations, the Associations
Incorporation Regulations 19981 are called the
Principal Regulations.
5. Particulars for application for incorporation
After regulation 5A(a) of the Principal
Regulations insert—
"(ab) the postal address of the proposed
incorporated association;".
6. Particulars for application for incorporation by a
company, co-operative, society etc.
For regulation 5C(i) of the Principal Regulations
substitute—
"(i) the postal address of the proposed
incorporated association;
(j) the signature of the person who made the
statement referred to in paragraph (h).".
7. Particulars for notice of special resolutions
approving amalgamation of incorporated
associations
For regulation 5G(g) of the Principal Regulations
substitute—
"(g) the postal address of the association to be
formed by the proposed amalgamation;
(h) the signature of the public officer.".

8. Particulars for application as an amalgamated
incorporated association
For regulation 5H(e) of the Principal Regulations
substitute—
"(e) the postal address of the incorporated
association to be formed by the proposed
amalgamation;
(f) the signatures of all the public officers of the
incorporated associations to be
amalgamated.".
9. Updating the name of accounting body
In regulation 7 of the Principal Regulations, for
"the Australian Society of Certified Practising
Accountants" substitute "CPA Australia".
10. Prescribing further offences for which a penalty
notice can be issued
In Part 2 of Schedule 4 to the Principal
Regulations, after item 5 insert—
"5A 45A(2C) Failure to comply with a
requirement of the Registrar 1
5B 45A(4) Failure by incorporated
association to keep the original
of a document lodged with the
Registrar for a period of
7 years after the date of lodging 5"
