No. 17/2003 Conservation, Forests and Lands Act 1987 Conservation, Forests and Lands (Infringement Notice) (Waterways) Regulations 2003 The Governor in Council makes the following Regulations: Dated: 4 February 2003 Responsible Minister: JOHN THWAITES Minister for Environment HELEN DOYE Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend Schedule 2 to the Conservation, Forests and Lands (Infringement Notice) Regulations 2002 to prescribe— (a) further offences against a relevant law for which an infringement notice may be served; and (b) penalties for those prescribed offences. 2. Authorising provision These Regulations are made under section 99 of the Conservation, Forests and Lands Act 1987. -- 2 of 8 -- S.R. Amendments to Schedule 2 In Schedule 2 to the Conservation, Forests and Lands (Infringement Notice) Regulations 20021 , after item 305 insert— "WATERWAYS 306 6662 An offence under regulation 8(2)(a) of the Water Industry (Waterways Land) Regulations 20022 $80 drive or park a vehicle in contravention of any sign posted by the Secretary in the particular area of regulated waterways land in which the vehicle is driven or parked other than in accordance with regulation 8(3) of the Water Industry (Waterways Land) Regulations 2002 307 6664 An offence under regulation 8(2)(e) of the Water Industry (Waterways Land) Regulations 2002 $100 enter a waterway on any regulated waterways land by jumping or diving from any bridge, jetty or wharf, or by dropping from a swinging rope or other support other than in accordance with regulation 8(3) of the Water Industry r. 3 -- 3 of 8 -- S.R. No. 17/2003 Conservation, Forests and Lands (Infringement Notice) (Waterways) Regulations 2003 3 (Waterways Land) Regulations 2002 308 6665 An offence under regulation 9(1) of the Water Industry (Waterways Land) Regulations 2002 $100 as a person in charge of a vessel, berth that vessel on any regulated waterways land other than in accordance with regulation 9(3) of the Water Industry (Waterways Land) Regulations 2002 309 6666 An offence under regulation 12 of the Water Industry (Waterways Land) Regulations 2002 $80 as the holder of a berthing authority, fail to comply with the terms and conditions of that authority 310 6667 An offence under regulation 13 of the Water Industry (Waterways Land) Regulations 2002 $200 as the owner of a vessel, cause or allow the operation of that vessel as a trading vessel used for the carriage of passengers on regulated waterways land without a permit to do so under regulation 15 of the Water Industry (Waterways r. 3 -- 4 of 8 -- S.R. No. 17/2003 Conservation, Forests and Lands (Infringement Notice) (Waterways) Regulations 2003 4 Land) Regulations 2002 311 6668 An offence under regulation 14 of the Water Industry (Waterways Land) Regulations 2002 $200 hire to another person a hire and drive vessel for use on regulated waterways land without a permit to do so under regulation 16 of the Water Industry (Waterways Land) Regulations 2002 312 6670 An offence under regulation 18 of the Water Industry (Waterways Land) Regulations 2002 $100 as the holder of a trading vessel permit or a hire and drive permit, fail to cause to be prominently displayed on each vessel operated or hired under the permit, in a form approved by the Secretary, at least one notice that the vessel is operating under a permit which includes the details specified in regulation 18 of the Water Industry (Waterways Land) Regulations 2002 r. 3 -- 5 of 8 -- S.R. No. 17/2003 Conservation, Forests and Lands (Infringement Notice) (Waterways) Regulations 2003 5 313 6671 An offence under regulation 19 of the Water Industry (Waterways Land) Regulations 2002 $200 as a holder of a trading vessel permit or a hire and drive permit, cause advertising that has not been authorised in accordance with the permit to be displayed on regulated waterways land 314 6672 An offence under regulation 20 of the Water Industry (Waterways Land) Regulations 2002 $100 as a person in charge of a vessel which is operated under a trading vessel permit provide a cruise service on the Yarra River upstream of Herring Island between 11 p.m. and 7.30 a.m. other than in accordance with regulation 20(2) of the Water Industry (Waterways Land) Regulations 2002 315 6673 An offence under regulation 22(1) of the Water Industry (Waterways Land) Regulations 2002 $200 carry out any commercial activity or offer, advertise or display services relating to any commercial activity on any regulated waterways land r. 3 -- 6 of 8 -- S.R. No. 17/2003 Conservation, Forests and Lands (Infringement Notice) (Waterways) Regulations 2003 6 without a written authority from the Secretary to do so 316 6674 An offence under regulation 23(1) of the Water Industry (Waterways Land) Regulations 2002 $100 take part in organising or conducting an organised activity on regulated waterways land without a written authority from the Secretary to do so". 4.
