950 QUEENSLAND GOVERNMENT INDUSTRIAL GAZETfE 21 March, 1997 ########################################################## QUEENSLAND INDUSTRIAL RELATIONS COMMISSION Industrial Relations Act 1990 (s 136) Chubb Protective Services AND Australian Liquor, Hospitality and Miscellaneous Workers Union, Queensland Branch, Union of Employees (No. JA83 of/996) SECURITY INDUSTRY (CONTRACTORS) AW ARD- CHUBB PROTECTIVE SERVICES AHM TOOWOOMBA SITE INDUSTRIAL AGREEMENT COMMISSIONER FISHER 13 December 1996 THIS AGREEMENT, made in pursuance of the Industrial Relations Act 1990 this fourth day of December 1996, between Chubb Protective Services and the Australian Liquor, Hospitality and Miscellaneous Workers Union, Queensland Branch, Union of Employees witnesseth that it is hereby mutually agreed as follows:- PART !PRELIMINARY 1.1 Application of Agreement ( l) This Agreement shall have application to financial members of the LHMU who are employees of Chubb Protective Services whose conditions of employment would otherwise have been determined by the Security Industry (Contractors) Award - State (hereinafter referred to a<; "the parent Award") whilst employed for the purposes of providing security services at the AHM Toowoomba Site. (2) Save as in hereinafter provided, all conditions of the parent Award shall have application and the terms of this Agreement shall apply in the case of any inconsistency hctween this Agreement and the said A ward. PART 2TERMS AND CONDITIONS OF EMPLOYMENT 2.1 Hours of Duty ( 1) Employees of the subject of this Agreement shall work to a roster agreed between the employer, the majority of employees affected and the Union. Such roster shall be agreed in writing and exchanged between the parties. (2) Facility hereby exists for the working of shifts of up to 12 ordinary hours per day. 2.2 Rate of Pay (I) Employees under this Agreement shall be paid a wage, which has been agreed between the parties, based upon the following: (a) The weekly wage rate payable at the Level I Classification in the parent A ward; plus (b) Shift Allowances. Weekend Penalty Rates; (c) Public Holidays paid 12 hours at appropriate rates as per award; pius (d) 2 hours per week overtime at the last day work in each week roster. (2) Wage rates shall be adjusted in accordance with movements in the parent Award in any of the factors mentioned in subclause ( l) above (3) Overtime and Annual Le.Ive Loading shall be calculated on the aggregated hourly rate. 21 March, 1997 QUEENSLAND GOVERNMENT INDUSTRIAL GAZETTE PART 3TERMS OF AGREEMENT 3.1 Terms of Agreement This Agreement shall take effect and have force of law as from the fourth day of December 1996 and shall remain in force for twelve months and thereafter until such time as either party gives 30 days notice of their retirement.
